1 AN ACT
2 To enact R.S. 40:1223.4(D), relative to telehealth services; to provide for the use of
3 telehealth; to provide for the regulation of telehealth by certain licensing boards; to
4 require synchronous interactions with a patient for certain conditions; to provide for
5 an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1223.4(D) is hereby enacted to read as follows:
8 §1223.4. Telehealth; rulemaking required

10 D. The Louisiana State Board of Medical Examiners and the Louisiana
11 State Board of Nursing shall not adopt or enforce any rule or policy that
12 prohibits a licensed healthcare provider under the jurisdiction of either board
13 from using telehealth to evaluate, diagnose, or treat obesity or provide weight
14 management services, provided the healthcare provider conducts a synchronous
15 interaction with the patient and acts within the scope of his license and in
16 accordance with the applicable standard of care.
17 Section 2. This Act shall become effective upon signature by the governor or, if not
18 signed by the governor, upon expiration of the time for bills to become law without signature

1 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
