2 To amend and reenact R.S. 14:108.1(E)(2) and to enact R.S. 14:108.1(E)(3) and (G) and
3 R.S. 15:571.11(A)(1)(e), relative to aggravated flight from an officer; to provide a
4 minimum time of imprisonment; to provide relative to the distribution of collected
5 fines; to require seizure of insurance proceeds in certain circumstances; and to
6 provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 14:108.1(E)(2) is hereby amended and reenacted and R.S.
9 14:108.1(E)(3) and (G) are hereby enacted to read as follows:
10 §108.1. Flight from an officer; aggravated flight from an officer

13 (2) Whoever commits the crime of aggravated flight from an officer that
14 results in serious bodily injury shall be imprisoned at hard labor for not less than
15 two years nor more than fifteen years, without benefit of parole, probation, or
16 suspension of sentence, and may be fined not more than two thousand dollars.
17 (3) Any insurance proceeds, received or to be received, directly or
18 indirectly by either a defendant charged with violating Subsection C of this
19 Section or any agent, assignee, or representative of the defendant, as a direct or
20 indirect result of the defendant's crime shall be subject to the provisions of R.S.

2 from fines imposed pursuant to this Section shall be deposited into an account
3 set aside by the agency and utilized to support either high-speed pursuit driver
4 training or the acquisition of devices or technology designed to minimize the
5 risk to the public inherent to high-speed police pursuits in accordance with R.S.
6 15:571.11(A)(1)(e).
7 Section 2. R.S. 15:571.11(A)(1)(e) is hereby enacted to read as follows:

10 (e) Notwithstanding any other provision of law to the contrary, funds
11 received by a parish law enforcement agency that are derived from fines
12 imposed for a violation of R.S. 14:108.1 shall be deposited into an account set
13 aside by the agency and utilized to support either high-speed pursuit driver
14 training or the acquisition of devices or technology designed to minimize the
15 risk to the public inherent to high-speed police pursuits.
