2 To enact R.S. 29:726(E)(31), relative to the Governor's Office of Homeland Security and
3 Emergency Preparedness; to provide for authority and responsibilities; to require the
4 office to perform certain functions or to assign functions to another state agency or
5 department; to provide for promulgation of rules establishing cybersecurity standards
6 applicable to local governmental subdivisions and political subdivisions that seek
7 state assistance in response to a cybersecurity incident; to authorize promulgation of
8 certain emergency rules; and to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 29:726(E)(31) is hereby enacted to read as follows:
11 §726. Governor's Office of Homeland Security and Emergency Preparedness;

14 E. The office shall either directly or through authorized assignment to another
15 state agency or department:

17 (31) Promulgate rules in accordance with the Administrative Procedure
18 Act establishing cybersecurity standards applicable to local governmental
19 subdivisions and political subdivisions that seek state assistance in response to
20 a cybersecurity incident.
21 (a) The rules shall at a minimum establish cybersecurity standards for
22 technical management practices that assure cybersecurity compliance with
23 national cybersecurity standards and set forth eligibility requirements for
24 receiving state assistance in response to a cybersecurity incident.
25 (b) Nothing in this Paragraph shall be construed to prevent the
26 Governor's Office of Homeland Security and Emergency Preparedness from
27 entering into a contract to provide services to a local governmental subdivision

1 or political subdivision that is not in compliance with the cybersecurity
2 standards promulgated pursuant to this Paragraph. Reimbursement of costs
3 associated with these services shall be the obligation of the noncompliant local
4 governmental subdivision or political subdivision.
5 (c) The office may promulgate emergency rules to provide for the initial
6 implementation of the provisions of this Paragraph.
