2 To amend and reenact R.S. 22:1028(B)(1) and to enact R.S. 22:1028(B)(3), relative to
3 prostate cancer screening; to provide for insurance coverage for screening of men
4 over the age of forty in accordance with the guidelines from the National
5 Comprehensive Cancer Network; to prohibit out-of-pocket expenses for cancer
6 screening services; to provide for applicability; to provide for an effective date; and
7 to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 22:1028(B)(1) is hereby amended and reenacted and R.S.
10 22:1028(B)(3) is hereby enacted to read as follows:
11 §1028. Early screening and detection requirements; examination; coverage

13 B.(1) Any health coverage plan which is delivered or issued for delivery in
14 the state shall provide coverage for detection of prostate cancer, including digital
15 rectal examination and prostate-specific antigen testing for men over the age of fifty
16 years and as medically necessary and appropriate for men over between the age ages
17 of forty to forty-nine years in accordance with the most recently published
18 guidelines from the National Comprehensive Cancer Network.

20 (3) Any coverage required pursuant to the provisions of this Subsection
21 shall not be subject to any cost-sharing amount, including deductibles,
22 coinsurance, copayment, or similar out-of-pocket expenses.

2 Section 2. The provisions of this Act shall apply to any new policy, contract,
3 program, or health coverage plan issued on or after January 1, 2027. Any policy, contract,
4 or health coverage plan in effect prior to January 1, 2027, shall convert to conform to the
5 provisions of this Act on or before the renewal date, but no later than January 1, 2028.
6 Section 3. This Act shall become effective upon signature by the governor, or, if not
7 signed by the governor, upon expiration of time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by this legislature, this Act shall become
10 effective on the day following such approval.
