1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 5 MRSA §20043, sub-§9 is enacted to read:
39. Discharge. Upon completion of a treatment program, the facility must ensure that
4 the person is discharged to the care of a responsible adult who the facility has determined
5 is able to support the person's adjustment to discharge from the treatment program.
6Sec. 2. 34-A MRSA §3047, sub-§3, ¶D, as amended by PL 1991, c. 314, §52, is
7 further amended to read:
8 D. If the prisoner requests a reasonable place nearer the place of incarceration than
9 any of the foregoing the places in paragraphs A to C, transportation must be furnished
10 to that place; or
11Sec. 3. 34-A MRSA §3047, sub-§4, as amended by PL 1991, c. 314, §52, is further
12 amended to read:
134. Extreme circumstances. May, in extreme circumstances, if the prisoner's home is
14 outside the State, or if the prisoner has secured employment outside the State, furnish
15 transportation to the prisoner's home or place of employment. ; or
16Sec. 4. 34-A MRSA §3047, sub-§5 is enacted to read:
175. Support from responsible adult. Shall ensure that the prisoner is released to the
18 care of a responsible adult who the commissioner has determined is able to support the
19 prisoner's transition from incarceration.
20SUMMARY
21 This bill requires the Department of Health and Human Services to adopt rules to
22 require a substance use disorder treatment facility to ensure that a patient is discharged to
23 the care of a responsible adult as determined by the facility. The bill also requires the
24 Commissioner of Corrections to ensure that, when a prisoner is released, the prisoner is
25 released to the care of a responsible adult as determined by the commissioner.
