1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 22 MRSA §2711 is enacted to read:
3§2711. Drug testing of pregnant persons and persons who have given birth
4 A health care provider may perform a blood test on a pregnant person with the person's
5 consent directly before childbirth to determine the presence of any drug or medication prior
6 to administering any drug or medication to the person. The health care provider shall
7 maintain a record of any drug or medication administered to the pregnant person during
8 childbirth. The health care provider may perform a blood test on the person who gave birth
9 with the person's consent to determine the presence of any drug or medication subsequent
10 to childbirth. The results of all blood tests under this section must be reconciled prior to a
11 report of drug use being made. If a report of drug use under this section is made, all records
12 required to be maintained under this section and the results of all blood tests taken under
13 this section must accompany the report. As used in this section, "health care provider" has
14 the same meaning as in Title 4, section 1201, subsection 10-A.
15SUMMARY
16 This bill allows a health care provider to administer a blood test before and after
17 childbirth to a pregnant person with the person's consent to determine the presence of drugs
18 or medications and requires a record to be kept of any drug or medication administered to
19 the pregnant person during childbirth. Prior to a report of drug use being made, all blood
20 tests must be reconciled, and all records of drugs and medications administered and the
21 results of the blood tests must accompany the report.
