1Emergency preamble. Whereas, acts and resolves of the Legislature do not
2 become effective until 90 days after adjournment unless enacted as emergencies; and
3Whereas, this legislation amends the law relating to license classes to allow local
4 units of government to expeditiously address removal of snow or ice from roadways and
5 needs to take effect during this winter season; and
6Whereas, in the judgment of the Legislature, these facts create an emergency within
7 the meaning of the Constitution of Maine and require the following legislation as
8 immediately necessary for the preservation of the public peace, health and safety; now,
9 therefore,
10Be it enacted by the People of the State of Maine as follows:
11Sec. 1. 29-A MRSA §1252-A is enacted to read:
12§1252-A. Class M license
13 Notwithstanding any provision of law to the contrary, a Class M license may be issued
14 to a city, town, county, district or other local unit of government created by or pursuant to
15 law for the operation of a single motor vehicle or a combination of vehicles that meet the
16 definition of a Class A or Class B license for the purpose of removing snow or ice from a
17 roadway by plowing or sanding within the boundaries of that local unit of government. A
18 Class M license must be held by that local unit of government and must be assigned to only
19 one individual employed by that local unit of government. There is no limit on the number
20 of Class M licenses issued to a local unit of government. An individual who is assigned to
21 operate a single motor vehicle or a combination of vehicles under a Class M license must
22 pass all required written and road safety tests.
23Emergency clause. In view of the emergency cited in the preamble, this legislation
24 takes effect when approved.
25SUMMARY
26 This bill creates a Class M license that may be issued to a local unit of government for
27 the operation of a single motor vehicle or combination of vehicles that meet the definition
28 of a Class A or Class B license for the purpose of removing snow or ice from a roadway
29 by plowing or sanding within the boundaries of that local unit of government. A Class M
30 license must be held by that local unit of government and must be assigned to only one
31 individual employed by that local unit of government.
