1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 20-A MRSA §15907-A is enacted to read:
3§15907-A. State share of school construction costs on or after July 1, 2026
4 Notwithstanding any provision of law to the contrary, beginning July 1, 2026, the
5 State's share of the total cost of a school construction project must be calculated in
6 accordance with this section.
71. State's share. The State's share of the total cost of a school construction project for
8 a school administrative unit is the greater of:
9 A. Twenty-five percent of the total cost of the school construction project; and
10 B. A percentage equal to the state share percentage of the school administrative unit's
11 total cost of education as determined under section 15688. For the purposes of this
12 paragraph, "state share percentage" has the same meaning as in section 15672,
13 subsection 31.
142. Rulemaking. The state board may adopt or amend rules related to the State's share
15 of the total cost of a school construction project as necessary to implement this section.
16 Rules adopted pursuant to this subsection are major substantive rules pursuant to Title 5,
17 chapter 375, subchapter 2-A.
18SUMMARY
19 This bill provides that, beginning July 1, 2026, the State's share of the total cost of a
20 school construction project is either 25% of the total cost of the school construction project
21 or a percentage equal to the state share percentage of the school administrative unit's total
22 cost of education as determined in the essential programs and services funding formula,
23 whichever is greater. The bill also allows the State Board of Education to adopt or amend
24 rules related to the State's share of the total cost of a school construction project.
