1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 34-A MRSA §11205 is enacted to read:
3§11205. Municipal ordinance compliance
4 In addition to the requirements and restrictions of this chapter, an offender shall comply
5 with any applicable municipal ordinances adopted pursuant to Title 30-A, section 3014,
6 subsection 2.

10 with any applicable municipal ordinances adopted pursuant to Title 30-A, section 3014,
11 subsection 2.
12Sec. 3. Sex Offender Management and Risk Assessment Advisory
13Commission; study. The Sex Offender Management and Risk Assessment Advisory
14 Commission, established pursuant to the Maine Revised Statutes, Title 34-A, section
15 11401, shall conduct a study and develop recommendations regarding statewide residency
16 restrictions for sex offenders. In conducting the study, the commission shall evaluate
17 whether residency restrictions for sex offenders improve public safety, the best
18 implementation methods for residency restrictions and any constitutional or legal issues
19 associated with sex offender residency restrictions. No later than December 3, 2025, the
20 commission shall submit a report containing the findings and recommendations of this
21 study, including any proposed legislation, to the Joint Standing Committee on Criminal
22 Justice and Public Safety. After reviewing the report, the committee may report out
23 legislation relating to the report to the Second Regular Session of the 132nd Legislature.
24SUMMARY
25 This bill amends the Sex Offender Registration and Notification Act of 1999 and the
26 Sex Offender Registration and Notification Act of 2013 by requiring that offenders under
27 the Acts comply with municipal residency restriction ordinances adopted pursuant to the
28 Maine Revised Statutes, Title 30-A, section 3014, subsection 2. The bill also directs the
29 Sex Offender Management and Risk Assessment Advisory Commission to conduct a study
30 and develop recommendations regarding a statewide residency restriction for sex offenders.
31 The commission is directed to submit a report containing its findings and proposed
32 legislation to the Joint Standing Committee on Criminal Justice and Public Safety no later
33 than December 3, 2025. The committee may report out legislation relating to the report to
34 the Second Regular Session of the 132nd Legislature.
