1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 20-A MRSA §1002, sub-§2-C is enacted to read:
32-C. Permissive volunteer placement by school administrative unit.
4 Notwithstanding subsection 2-A, a school board may, but is not required to, permit a
5 superintendent's or school board member's spouse or other family member to serve as a
6 volunteer. A school board may adopt a written policy on nepotism to discourage favoritism
7 and political patronage, consider the needs of the school system and provide that all
8 volunteers have a fair and equal opportunity to be selected on merit, with priority
9 consideration given to the best interest of students without restrictions based solely on
10 family association.
11SUMMARY
12 This bill reestablishes a law that was repealed through a statutory repeal clause in 2024
13 that allows a school board to permit a spouse of a school board member to serve as a
14 volunteer. This bill expands the law that was repealed in 2024 to include a superintendent's
15 or school board member's spouse or other family members.
