1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 32 MRSA §18302, sub-§1-A is enacted to read:
31-A. Botulinum toxin. "Botulinum toxin" means a neurotoxic protein produced by
4 the bacterium Clostridium botulinum and related species used for various medical and other
5 purposes, including treating muscle spasms, wrinkles and excessive sweating.
6Sec. 2. 32 MRSA §18302, sub-§17-A is enacted to read:
717-A. Dermal filler. "Dermal filler" means a gel-like substance that is injected
8 beneath the skin to restore lost volume, smooth lines or soften creases on the face or
9 enhance facial contours.
10Sec. 3. 32 MRSA §18371, sub-§1, ¶O, as corrected by RR 2021, c. 1, Pt. A, §35,
11 is amended to read:
12 O. Administer botulinum toxin or dermal fillers to a patient with a diagnosed dental
13 condition or when that administration is identified as part of a patient's dental treatment
14 plan. A dentist who has successfully completed postgraduate training and certification
15 in oral and maxillofacial surgery from a program accredited by the American Dental
16 Association Commission on Dental Accreditation or its successor organization and
17 who has met the requirements of section 18395 may administer botulinum toxin or
18 dermal fillers in the course of treatment for oral or maxillofacial disease, disfigurement
19 or disjunction.
20Sec. 4. 32 MRSA §18395 is enacted to read:
21§18395. Botulinum toxin or dermal fillers
221. Botulinum toxin or dermal fillers. A dentist may administer botulinum toxin or a
23 dermal filler for a diagnosed dental condition or as part of a patient's dental treatment
24 pursuant to this section and section 18371, subsection 1, paragraph O.
252. Additional requirements to administer botulinum toxin or dermal fillers. In
26 addition to the requirements of section 18371, subsection 1, paragraph O, a dentist may
27 administer botulinum toxin or a dermal filler if the dentist has completed training accredited
28 by the American Dental Association's program for continuing education recognition, the
29 Academy of General Dentistry's program approval for continuing education or another
30 nationally recognized and accredited training program approved by the board.
31 A. For botulinum toxin, the dentist must have completed a minimum of 8 hours of
32 training in the administration of botulinum toxin that includes instruction in the
33 anatomy of the head and neck, neurophysiology, patient selection, pharmacological
34 effects and contraindications, management of complications and informed consent
35 requirements and hands-on training in the administration of botulinum toxin.
36 B. For a dermal filler, the dentist must have completed a minimum of 8 hours of
37 training in the administration of a dermal filler that includes instruction in the anatomy
38 of the head and neck, neurophysiology, patient selection, pharmacological effects and
39 contraindications, management of complications and informed consent requirements
40 and hands-on training in the administration of a dermal filler.
413. Administration of botulinum toxin or dermal fillers. Prior to administering
42 botulinum toxin or a dermal filler, a dentist shall:

1 A. Obtain the patient's medical and dental history;
2 B. Perform a clinical examination; and
3 C. Obtain the informed consent of the patient.
4SUMMARY
5 This bill adds additional requirements for dentists to administer botulinum toxin or
6 dermal fillers to patients.
