1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 21-A MRSA §33, as enacted by PL 1993, c. 473, §2 and affected by §46, is
3 amended to read:
4§33. Prosecution Investigation and prosecution of violations
5 The Secretary of State shall designate sworn law enforcement officers employed by the
6 Department of the Secretary of State to investigate alleged violations of the election laws.
7 The Attorney General shall designate a Deputy Attorney General or an Assistant Attorney
8 General to investigate assist in the investigation of and to prosecute alleged violations of
9 the election laws. This section does not preclude a district attorney from investigating and
10 prosecuting election law violations.
11SUMMARY
12 This bill requires the Secretary of State to designate sworn law enforcement officers
13 employed by the Department of the Secretary of State to investigate alleged violations of
14 the election laws. It also changes the current law to require the Attorney General to
15 designate a Deputy Attorney General or an Assistant Attorney General to assist in the
16 investigation.
