1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 29-A MRSA §1916, sub-§2, ¶A, as amended by PL 2007, c. 186, §2, is
3 further amended by amending subparagraph (4) to read:
4 (4) Motor vehicles for which the Chief of the State Police has granted an exception
5 because the health of the owner or a person who usually occupies the vehicle is
6 adversely affected by sunlight. The Chief of the State Police may shall, upon
7 proper application, provide the owner of a motor vehicle with a certificate of
8 exemption that must be displayed upon the request of a law enforcement officer.
9 For the purposes of this subparagraph, the following terms have the following
10 meanings.
11 (a) "Certified nurse practitioner" means a registered professional nurse
12 licensed under Title 32, chapter 31 who has received postgraduate education
13 designed to prepare the nurse for advanced practice registered nursing in a
14 clinical specialty in nursing that has a defined scope of practice and who has
15 been certified in the clinical specialty by a national certifying organization
16 acceptable to the State Board of Nursing.
17 (b) "Medical provider" means an optometrist, a physician, a physician
18 assistant or a certified nurse practitioner.
19 (c) "Optometrist" has the same meaning as in Title 32, section 19101,
20 subsection 20.
21 (d) "Physician" means an individual licensed as an osteopathic physician by
22 the Board of Osteopathic Licensure pursuant to Title 32, chapter 36 or an
23 individual licensed as a physician or surgeon by the Board of Licensure in
24 Medicine pursuant to Title 32, chapter 48.
25 (e) "Physician assistant" means an individual licensed as a physician assistant
26 by the Board of Osteopathic Licensure pursuant to Title 32, chapter 36 or an
27 individual licensed as a physician assistant by the Board of Licensure in
28 Medicine pursuant to Title 32, chapter 48.
29 (f) "Proper application" means an application that includes a written request
30 signed by a medical provider.
31SUMMARY
32 This bill requires the Chief of the State Police to provide the owner of a motor vehicle
33 with a certificate of exemption from the laws prohibiting reflective or tinted windows upon
34 written request signed by a medical provider.
