1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 12 MRSA §6702, sub-§8 is enacted to read:
38. Scallop dragging license; island communities. The commissioner shall allocate
4 one scallop dragging license for each of the following island communities to be issued to
5 an applicant who is a resident of each community:
6 A. Chebeague Island;
7 B. Cliff Island;
8 C. Frenchboro;
9 D. Great Cranberry Island;
10 E. Isle au Haut;
11 F. Islesboro;
12 G. Islesford;
13 H. Long Island in Casco Bay;
14 I. Matinicus Isle;
15 J. Monhegan;
16 K. North Haven;
17 L. Peaks Island;
18 M. Swan's Island; and
19 N. Vinalhaven.
20 A license issued pursuant to this subsection may not be transferred to a resident of an island
21 community other than the community to which the commissioner allocated the license. If
22 a license that is allocated for an island community goes unissued for 3 consecutive years,
23 the commissioner may reallocate that license to another community listed under this
24 subsection.
25 The commissioner shall work with the municipal officers of the island communities listed
26 under this subsection and with relevant local organizations within those communities to
27 implement and administer this subsection, including verifying applicant residency,
28 facilitating the allocation of licenses and identifying the need for additional licenses to be
29 issued as incentives to attract year-round residents.
30SUMMARY
31 This bill directs the Commissioner of Marine Resources to allocate one scallop
32 dragging license each for certain island communities to be issued to an applicant who is a
33 resident of each community. The bill prohibits a license issued to a resident of an island
34 community from being transferred to a resident of a community other than the community
35 to which the commissioner allocated the license. The bill also allows the commissioner to
36 reallocate a license that goes unissued for 3 consecutive years to another island community
37 and directs the commissioner to work with the municipal officers of the island communities
38 and relevant organizations within the communities to implement and administer the
39 provisions of the bill.
