1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 5 MRSA §60 is enacted to read:
3§60. Restricting social media platform user from commenting on state-shared content
4prohibited
5 The account holder or the administrator of a social media platform account of a state,
6 county or municipal department, agency, board or commission or a state, county or
7 municipal official operating in that individual's official capacity may not restrict a user of
8 that social media platform from commenting on content shared by the account holder or
9 the administrator of the social media platform account if the social media platform allows
10 a user to comment on content shared on the platform.
11 This section may not be construed to prevent a social media platform from adopting or
12 enforcing rules related to the type of content or the removal of certain content shared on
13 that social media platform.
14 For purposes of this section, "social media platform" means a publicly accessible
15 website or electronic medium that permits a person to become a registered user, establish
16 an account or create a profile for the purpose of allowing users to create, share and view
17 user-generated content.
18SUMMARY
19 This bill prohibits an account holder or administrator of a social media platform
20 account of a state, county or municipal department, agency, board or commission or a state,
21 county or municipal official operating in that individual's official capacity from restricting
22 a user of that social media platform from commenting on content shared by the holder or
23 the administrator of the social media platform account.
