1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 17-A MRSA §1107-A, sub-§1, ¶B, as repealed and replaced by PL 2015,
3 c. 496, §6, is amended to read:
4 B. Except as provided in paragraph B‑1, a schedule W drug and the drug contains:
5 (1) Heroin (diacetylmorphine) and the amount possessed is 2 grams or more than
6 200 milligrams;
7 (2) Cocaine and the amount possessed is 2 grams or more than 2 grams;
8 (3) Cocaine in the form of cocaine base and the amount possessed is 2 grams or
9 more than 2 grams;
10 (4) Oxycodone and the amount possessed is 2 grams or more than 200 milligrams;
11 (5) Hydrocodone and the amount possessed is 2 grams or more than 200
12 milligrams;
13 (6) Hydromorphone and the amount possessed is 2 grams or more than 200
14 milligrams;
15 (7) Methamphetamine and the amount possessed is 2 grams or more than 200
16 milligrams; or
17 (8) Fentanyl powder and the amount possessed is 2 grams or more than 200
18 milligrams.
19 Violation of this paragraph is a Class C crime;
20SUMMARY
21 Current law provides that intentional or knowing possession of certain schedule W
22 drugs is a Class C crime. This bill makes possession of under 2 grams of those schedule
23 W drugs a Class D crime.
