1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 32 MRSA §1732, sub-§5-A, as enacted by PL 2019, c. 277, §2, is amended
3 to read:
45-A. Perfluoroalkyl and polyfluoroalkyl substances; PFAS. "Perfluoroalkyl and
5 polyfluoroalkyl substances" or "PFAS" means any member of the class of fluorinated
6 organic chemicals containing at least one fully fluorinated carbon atom. any chemical
7 substance or mixture containing a chemical substance that structurally contains at least one
8 of the following 3 substructures:
9 A. R-(CF 2)-CF(R')R", where both the CF2 and CF moieties are saturated carbons;
10 B. R-CF 2OCF2-R', where R and R' can either be F, O or saturated carbons; or
11 C. CF 3C(CF3)R'R", where R' and R" can either be F or saturated carbons.
12Sec. 2. 38 MRSA §1614, sub-§1, ¶F, as enacted by PL 2021, c. 477, §1 and
13 reallocated by RR 2021, c. 1, Pt. A, §54, is amended to read:
14 F. "Perfluoroalkyl and polyfluoroalkyl substances" or "PFAS" means substances that
15 include any member of the class of fluorinated organic chemicals containing at least
16 one fully fluorinated carbon atom. any chemical substance or mixture containing a
17 chemical substance that structurally contains at least one of the following 3
18 substructures:
19 (1) R-(CF 2)-CF(R')R", where both the CF2 and CF moieties are saturated carbons;
20 (2) R-CF 2OCF2-R', where R and R' can either be F, O or saturated carbons; or
21 (3) CF 3C(CF3)R'R", where R' and R" can either be F or saturated carbons.
22SUMMARY
23 This bill changes the definition of "perfluoroalkyl and polyfluoroalkyl substances" or
24 "PFAS" in the laws governing reduction of toxics in packaging, the sale of products
25 containing intentionally added PFAS, the Fund to Address PFAS Contamination,
26 pesticides, renewable energy procurement in contaminated land, firefighting or fire-
27 suppressing foam, waste discharge licenses, licenses to spread septage and the Land
28 Application Containment Monitoring Fund to align with the United States Environmental
29 Protection Agency's definition of "PFAS."
