1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 25 MRSA §2468, sub-§4, as amended by PL 2017, c. 322, §9, is further
3 amended to read:
44. New construction. A person who constructs any of the following shall install or
5 cause to be installed at least one carbon monoxide detector in each area within, or giving
6 access to, any bedroom in the new construction of:
7 A. A single-family dwelling;
8 B. A hotel, motel, inn or bed and breakfast upon initial licensure of that new
9 construction as an eating establishment or a lodging place under Title 22, chapter 562
10 on or after August 1, 2012; or
11 C. A fraternity house, sorority house or dormitory established on or after August 1,
12 2012 that is affiliated with a private or public school or private or public postsecondary
13 institution incorporated or chartered under the laws of this State. ; or
14 D. Beginning January 1, 2027, in addition to the structures described in paragraphs A,
15 B and C, any occupancy for which the installation of carbon monoxide detectors is
16 required by the Life Safety Code of the National Fire Protection Association as adopted
17 by the Commissioner of Public Safety.
18 The carbon monoxide detector must be powered both by the electrical service in the
19 building or dwelling and by battery.
20Sec. 2. 25 MRSA §2468, sub-§7, as enacted by PL 2009, c. 162, §5, is amended to
21 read:
227. Rules. The Commissioner of Public Safety or the commissioner's designee, in
23 accordance with the Maine Administrative Procedure Act, shall may adopt rules pertaining
24 to carbon monoxide detectors. The rules adopted must include, but are not limited to,
25 standards for approved carbon monoxide detectors and all requirements of use,
26 maintenance and installation. Rules adopted pursuant to this subsection are routine
27 technical rules as defined in Title 5, chapter 375, subchapter 2‑A.
28Sec. 3. 25 MRSA §2468, sub-§11, as amended by PL 2015, c. 396, §2, is further
29 amended to read:
3011. Educational facilities. An educational facility shall install, or cause to be
31 installed, by the manufacturer's requirements at least one approved carbon monoxide
32 detector detectors by the manufacturer's requirements and in accordance with the
33 requirements of the Life Safety Code of the National Fire Protection Association as adopted
34 by the Commissioner of Public Safety in each building of the educational facility that is
35 used for educational purposes by at least 6 persons for at least 4 hours per day or more than
36 12 hours per week. The owner shall use a carbon monoxide detector that is powered by:
37 A. Both the electrical service in the building and a battery;
38 B. A nonreplaceable 10-year battery; or
39 C. A replaceable battery if the carbon monoxide detector uses a low-power radio
40 frequency wireless communication signal, uses multiple sensors, has low-frequency
41 audible notification capability or is connected to a control panel.

1Sec. 4. 25 MRSA §2468, sub-§14 is enacted to read:
214. Enforcement. This section may be enforced by the Office of the State Fire
3 Marshal; a state, county or municipal law enforcement officer; a municipal code
4 enforcement officer; or a state, county or municipal fire inspector.
5SUMMARY
6 This bill modifies provisions of law governing the use of carbon monoxide detectors
7 in this State. The bill does the following.
8 1. It requires that, beginning January 1, 2027, a person install carbon monoxide
9 detectors in the bedrooms and areas giving access to the bedrooms of any newly constructed
10 occupancy in accordance with the Life Safety Code of the National Fire Protection
11 Association as adopted by the Commissioner of Public Safety.
12 2. It modifies language to permit, rather than require, the Commissioner of Public
13 Safety to adopt rules pertaining to carbon monoxide detectors.
14 3. It modifies requirements related to carbon monoxide detectors in educational
15 facilities to require an educational facility to install carbon monoxide detectors in
16 accordance with the Life Safety Code of the National Fire Protection Association as
17 adopted by the Commissioner of Public Safety, rather than requiring only a minimum of
18 one carbon monoxide detector.
19 4. It also clarifies that the Office of the State Fire Marshal and certain other state,
20 county and municipal officials are authorized to enforce the provisions of law related to
21 carbon monoxide detectors.
