Resolve, Authorizing the Director of the Bureau of Parks and Lands to
Convey Public Land Parcels in Lincoln Plantation and Sandy River
Plantation
Preamble. The Constitution of Maine, Article IX, Section 23 requires that real estate
held by the State for conservation or recreation purposes may not be reduced or its uses
substantially altered except on the vote of 2/3 of all members elected to each House; and
Whereas, certain real estate authorized for conveyance by this resolve is under the
designations described in the Maine Revised Statutes, Title 12, section 598-A; and
Whereas, the Director of the Bureau of Parks and Lands within the Department of
Agriculture, Conservation and Forestry may sell or exchange lands with the approval of
the Legislature in accordance with the Maine Revised Statutes, Title 12, section 1851; now,
therefore, be it
Sec. 1. Director of the Bureau of Parks and Lands authorized to convey
certain land in Lincoln Plantation. Resolved: That the Director of the Bureau of
Parks and Lands within the Department of Agriculture, Conservation and Forestry may by
quitclaim deed convey without covenant, on other terms and conditions as the director may
direct, the State's interest in 47 leased lots and 14 adjacent vacant lots in Lincoln Plantation.
A survey must be completed to determine the boundaries of the lots to be conveyed. The
cost of a survey of the property boundaries may be paid by the bureau and factored into the
purchase price, but the recording costs may not be paid by the bureau.
Sec. 2. Director of the Bureau of Parks and Lands authorized to exchange
certain land in Sandy River Plantation. Resolved: That the Director of the Bureau
of Parks and Lands within the Department of Agriculture, Conservation and Forestry is
authorized to exchange a small leased parcel and additional land up to 0.25 acres in Sandy
River Plantation in a value-for-value transaction for a deeded right-of-way across an
adjacent parcel.
