1Emergency preamble. Whereas, acts and resolves of the Legislature do not
2 become effective until 90 days after adjournment unless enacted as emergencies; and
3Whereas, this legislation must take effect before the end of the 90-day period so that
4 Department of Transportation rules may be timely adopted; and
5Whereas, in the judgment of the Legislature, these facts create an emergency within
6 the meaning of the Constitution of Maine and require the following legislation as
7 immediately necessary for the preservation of the public peace, health and safety; now,
8 therefore, be it
9Sec. 1. Department of Transportation rule; greenhouse supplies.
10Resolved: That the Department of Transportation shall amend its rule Chapter 308: Rules
11 to Establish Seasonal Load Restrictions on Certain State and State Aid Highways in section
12 1, subsection 6, in the definition of "special commodity" to include greenhouse supplies for
13 agriculture, including, but not limited to, compost, planting mix, containers for growing
14 seedlings and greenhouse coverings and greenhouse construction materials.
15 For the purposes of this resolve, "greenhouse covering" means the material used to
16 cover a greenhouse to protect plants inside and control the internal environment of the
17 greenhouse.
18Emergency clause. In view of the emergency cited in the preamble, this legislation
19 takes effect when approved.
20SUMMARY
21 This resolve directs the Department of Transportation to amend its rule Chapter 308:
22 Rules to Establish Seasonal Load Restrictions on Certain State and State Aid Highways to
23 include greenhouse supplies for agriculture in the definition of "special commodity."
