Resolve, Directing the Maine Office of Community Affairs to Submit
Legislation and Take Other Actions to Effectuate the Transition of
Responsibility for Regulating Manufactured Housing Communities and the
Construction and Installation of Manufactured Homes from the
Manufactured Housing Board to the Maine Office of Community Affairs
Sec. 1. Legislation regarding transfer of rights and obligations of
Manufactured Housing Board. Resolved: That the Maine Office of Community
Affairs, referred to in this resolve as "the office," shall develop legislation to transition the
statutory responsibility for the oversight of manufactured housing manufacturers and
manufactured housing communities currently held by the Manufactured Housing Board,
established in the Maine Revised Statutes, Title 10, section 9003, subsection 1, and
administered by the Department of Professional and Financial Regulation, Office of
Professional and Occupational Regulation and to update the law to place the State in a
better position to increase the supply of manufactured housing and industrialized housing
in the State and to balance and protect the rights and responsibilities of owners and residents
of manufactured housing communities. With the assistance of the Office of Policy and
Legal Analysis and the Office of the Revisor of Statutes, the office shall review Title 10,
chapters 951 and 953 and other applicable statutes governing the oversight of manufactured
housing communities and the construction and installation of manufactured housing to:
1. Effectuate the transition of responsibilities from the Manufactured Housing Board
to the office;
2. Reduce conflicts and ambiguities in existing law; and
3. Correct any errors and inconsistencies in the law that result from this transition and
update.
Sec. 2. Office to consult. Resolved: That, in developing legislation under section
1 to effectuate the transition of responsibility and update and clarify the Maine Revised
Statutes, Title 10, chapters 951 and 953, the office shall consult with representatives of the
following groups:
1. Residents of manufactured housing communities;

2. Owners or managers of manufactured housing communities;
3. Businesses that construct manufactured housing;
4. Persons that install manufactured housing;
5. Municipal officers responsible for inspections of manufactured housing
communities and newly constructed and installed manufactured housing;
6. Current or former members of the Manufactured Housing Board;
7. Members of the joint standing committee of the Legislature having jurisdiction over
housing matters;
8. The Department of Professional and Financial Regulation; and
9. The Office of Policy Innovation and the Future.
Sec. 3. Public input. Resolved: That the office shall solicit public input on its
work under this resolve. The office shall hold at least one meeting to solicit public input
and shall post adequate notice of the meeting on its publicly accessible website.
Sec. 4. Transition of authority to act as state administrative agency.
Resolved: That the office shall take all action necessary to be authorized by the United
States Department of Housing and Urban Development to act as the state administrative
agency under 24 Code of Federal Regulations, Part 3282, Subpart G and 42 United States
Code, Sections 5401 to 5426.
Sec. 5. Legislation; report. Resolved: That, by January 1, 2027, the office shall
submit legislation developed pursuant to this resolve to the First Regular Session of the
133rd Legislature. The office shall submit a report to the joint standing committee of the
Legislature having jurisdiction over housing matters explaining the legislation submitted
and shall include specific information on the authorization by the United States Department
of Housing and Urban Development for the office to act as the state administrative agency
pursuant to 24 Code of Federal Regulations, Part 3282, Subpart G and 42 United States
Code, Sections 5401 to 5426.
