1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 17-A MRSA §1811, sub-§5-A is enacted to read:
35-A. Custody to Department of Corrections. If a person is denied bail under
4 subsection 5, cannot make bail set under subsection 5 or has other matters pending before
5 the court for which the person is incarcerated and bail has not yet been set, the person must
6 be remanded to the custody of the Department of Corrections until the person's pending
7 court proceedings or final disposition on the matters for which the person is incarcerated
8 has occurred.
9SUMMARY
10 This bill requires that, if a person who is charged with a probation violation is denied
11 bail at the person's initial appearance for the violation, cannot make bail or has other matters
12 for which the person is incarcerated and bail has not yet been set, the person must be
13 remanded to the custody of the Department of Corrections until the person's pending court
14 proceedings or final disposition on the matters for which the person is incarcerated has
15 occurred.
