1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 38 MRSA §3115, sub-§3, ¶B, as amended by PL 2023, c. 529, §6, is further
3 amended to read:
4 B. For the report required by this subsection that is due February 15, 2026, and for
5 each subsequent report, the department shall, at a minimum, include:
6 (1) Any recommendations for necessary adjustments to the amount of the handling
7 fee under section 3106, subsection 7; and
8 (2) Information regarding the status of the Cost and Carbon Efficient Technology
9 Fund under section 3114‑A, including, but not limited to, information regarding
10 the number and amount of grants issued under that fund, information on the
11 recipients of those grants and the technology that those grants were used to
12 support. ; and
13 (3) An evaluation and recommendations, including draft legislation as necessary,
14 regarding the inclusion within the scope of this chapter of additional container sizes
15 and types used to contain beverages or other consumer products that are not
16 beverages.
17Sec. 2. Department of Environmental Protection; beverage container
18redemption program report. The Department of Environmental Protection, in the
19 report required by the Maine Revised Statutes, Title 38, section 3115, subsection 3 that is
20 due February 15, 2026, in evaluating the inclusion of additional container sizes and types
21 within the scope of Title 38, chapter 33, as required by Title 38, section 3115, subsection
22 3, paragraph B, subparagraph (3), shall, at a minimum, evaluate and provide
23 recommendations, including draft legislation as necessary, regarding the inclusion under
24 the beverage container redemption program of clear glass containers that contain consumer
25 products that are not beverages.
26SUMMARY
27 This bill requires the Department of Environmental Protection to include an evaluation
28 and recommendations regarding the inclusion within the beverage container redemption
29 program of additional container sizes and types used to contain beverages or other
30 consumer products that are not beverages in its annual report to the joint standing
31 committee of the Legislature having jurisdiction over environment and natural resources
32 matters on the status of the program that is due February 15, 2026, and for each subsequent
33 report. The bill also specifically requires the department, in the report that is due February
34 15, 2026, to evaluate and provide recommendations regarding the inclusion under the
35 beverage container redemption program of clear glass containers that contain consumer
36 products that are not beverages.
