1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 22 MRSA §3174-PPP is enacted to read:
3§3174-PPP. Concurrent methadone treatment and intensive outpatient programs
41. Concurrent services. The department may not prohibit coverage of or otherwise
5 restrict coverage for individuals enrolled in the MaineCare program from receiving
6 methadone maintenance for the treatment of opioid use disorder and from concurrently
7 participating in medically appropriate intensive outpatient programs and other outpatient
8 services intended for the treatment of substance use disorder or behavioral health disorders.
92. Rulemaking. The department shall adopt rules to implement this section no later
10 than 90 days after the effective date of this section. Rules adopted under this subsection are
11 routine technical rules as defined in Title 5, chapter 375, subchapter 2‑A.
12SUMMARY
13 This bill prohibits the Department of Health and Human Services from prohibiting
14 coverage of or otherwise restricting coverage for individuals enrolled in the MaineCare
15 program from receiving methadone maintenance for the treatment of opioid use disorder
16 and from concurrently participating in medically appropriate intensive outpatient programs
17 and other outpatient services intended for the treatment of substance use disorder or
18 behavioral health disorders. It directs the department to adopt rules implementing these
19 requirements no later than 90 days after the effective date of the rules.
