1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 34-A MRSA §3036-A, sub-§10-A is enacted to read:
310-A. Prisoner served at least 15 years and crime committed prior to 26 years of
4age. With the consent of the prisoner, the commissioner may transfer a prisoner committed
5 to the department from a correctional facility to supervised community confinement
6 without meeting the eligibility requirements of subsection 2, paragraphs B, C and D if:
7 A. The prisoner is serving a term of imprisonment of at least 15 years;
8 B. The prisoner has served at least 15 years of the term of imprisonment imposed;
9 C. The crime or crimes for which the prisoner is serving the term of imprisonment
10 were committed before the prisoner attained 26 years of age; and
11 D. The prisoner has continuously maintained a custody classification level of medium,
12 medium trustee status or minimum for the 5 years preceding the prisoner's
13 consideration for the supervised community confinement program.
14SUMMARY
15 This bill establishes an exception to the standard eligibility criteria of the Department
16 of Corrections’ supervised community confinement program by allowing a prisoner to be
17 eligible if the prisoner is serving a term of imprisonment of at least 15 years, the prisoner
18 has served at least 15 years of the term of imprisonment, the prisoner has continuously
19 maintained a custody classification of medium, medium trustee status or minimum for the
20 5 years preceding the prisoner's consideration for the supervised community confinement
21 program and the crime or crimes for which the prisoner is serving the term of imprisonment
22 were committed before the prisoner attained 26 years of age.
