1Be it enacted by the People of the State of Maine as follows:
2Sec. 1. 32 MRSA §13786-G is enacted to read:
3§13786-G. Dispensing of ivermectin
41. Definitions. For the purposes of this section, unless the context otherwise indicates,
5 the following terms have the following meanings.
6 A. "COVID-19" has the same meaning as in Title 24-A, section 4320-P, subsection 1,
7 paragraph A.
8 B. "Standing order" means a written prescription drug order signed by a practitioner
9 acting within the lawful scope of the practitioner's license that specifies a protocol for
10 the dispensing of ivermectin under the delegated prescriptive authority of the
11 practitioner.
122. Dispensing of ivermectin. Upon a patient's request, a pharmacist may dispense
13 ivermectin to the patient without a prior prescription pursuant to a standing order subject
14 to the following requirements:
15 A. The standing order authorizes the dispensing of ivermectin to the patient for the
16 treatment of COVID-19, influenza or cancer;
17 B. The standing order specifies a mechanism to document any screening performed on
18 the patient and to document the prescription in the patient's medical record and includes
19 a plan for evaluating and treating any adverse event experienced by the patient; and
20 C. The pharmacist fulfills all documentation and other requirements established by the
21 board when dispensing ivermectin.
223. Legitimate medical purpose. A pharmacist who dispenses ivermectin under a
23 standing order is deemed to be dispensing ivermectin for a legitimate medical purpose in
24 the usual course of the practice of pharmacy.
254. Rules. The board may adopt rules to implement the requirements of this section.
26 Rules adopted by the board pursuant to this subsection are routine technical rules as defined
27 in Title 5, chapter 375, subchapter 2‑A.
28SUMMARY
29 This bill authorizes a pharmacist to dispense ivermectin upon request of a patient
30 pursuant to a standing order from a practitioner acting within the lawful scope of the
31 practitioner's license. The standing order must meet certain conditions, including
32 authorization to dispense ivermectin to a patient for the treatment of COVID-19, influenza
33 or cancer. A pharmacist who acts under a standing order is deemed to be dispensing
34 ivermectin for a legitimate medical purpose in the usual course of the practice of pharmacy.
