1Sec. 1. Department of Environmental Protection to review efficiency of
2solid waste disposal facility licensing. Resolved: That the Department of
3 Environmental Protection shall review the requirements in statute, department rules and
4 department policies that apply to the licensing of solid waste disposal facilities. The
5 purpose of the review is to identify efficiencies and inefficiencies in the license review
6 process. The review must include a general review of the license review process and a
7 targeted review of the license review process related to the Penobscot Energy Recovery
8 Company's waste-to-energy facility in the Town of Orrington. The review must also
9 include, but is not limited to, a review of impediments to the efficient review of license
10 applications, renewals and modifications; processing timelines and whether deadlines are
11 typically met and, if not, causes for the delays; ways to improve staffing to eliminate
12 inefficiencies; and methods to improve the licensing process. The department shall
13 establish a stakeholder group to advise the department on matters relating to the review.
14 By December 3, 2025, the department shall submit a report relating to the review, including
15 recommendations and any suggested legislation, to the Joint Standing Committee on
16 Environment and Natural Resources. The joint standing committee may report out a bill
17 relating to the report to the Second Regular Session of the 132nd Legislature.
18SUMMARY
19 This resolve directs the Department of Environmental Protection to review the
20 requirements in statute, department rules and department policies that apply to the licensing
21 of solid waste disposal facilities. The purpose of the review is to identify efficiencies and
22 inefficiencies in the license review process. The review must include a general review of
23 the license review process and a targeted review of the license review process related to the
24 Penobscot Energy Recovery Company's waste-to-energy facility in the Town of Orrington.
