Baltimore City – Alcoholic Beverages – Related Event Promoter’s Permit 2

FOR the purpose of reestablishing a related event promoter’s permit in Baltimore City; 3
authorizing the Board of License Commissioners for Baltimore City to issue a related 4
event promoter’s permit to certain applicants under certain circumstances; requiring 5
a holder of a State caterer’s license to obtain a certain Class C per diem license from 6
the Board before the holder may act as a participating license holder at a related 7
event; and generally relating to related event promoter’s permits in Baltimore City. 8

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19
That the Laws of Maryland read as follows: 20

This title applies only in Baltimore City. 3

(A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 5
INDICATED. 6

(2) “CIAA BASKETBALL TOURNAMENT” MEANS THE ANNUAL 7
BASKETBALL TOURNAMEN T OF THE CENTRAL INTERCOLLEGIATE ATHLETIC 8
ASSOCIATION. 9

(3) (I) “RELATED EVENT” MEANS AN EVENT IN WHICH: 10

1. A LICENSE HOLDER PAR TICIPATES IN A 11
COORDINATED PROMOTION WITH A THIRD–PARTY PROMOTER TO SELL OR PROVIDE 12
ALCOHOLIC BEVERAGES DURING A SPECIFIED TIME; AND 13

2. AT LEAST 75 INDIVIDUALS ARE REASONABLY 14
ANTICIPATED TO PARTICIPATE. 15

(II) “RELATED EVENT ” INCLUDES AN EVENT FO R WHICH 16
TICKETS ARE SOLD TO THE PUBLIC, EITHER IN ADVANCE OR AT THE DOOR , OR A 17
COVER CHARGE IS IMPOSED, INCLUDING A CONCERT, AN ENTERTAINMENT EVENT, A 18
HAPPY HOUR, OR A PARTY. 19

(4) “RELATED EVENT PROMOTE R” MEANS AN INDIVIDUAL , A 20
FOR–PROFIT ORGANIZATION, OR A NONPROFIT ORGAN IZATION THAT PROMOTES A 21
SOCIAL EVENT RELATED TO THE CIAA BASKETBALL TOURNAMENT AROUND THE 22
SAME TIME AND LOCATION AS THE CIAA BASKETBALL TOURNAMENT. 23

(B) THERE IS A RELATED EVENT PROMOTER’S PERMIT. 24

(C) (1) A RELATED EVENT PROMOT ER OR PARTICIPATING LICENSE 25
HOLDER ON BEHALF OF A RELATED EVENT PROMOTER SHALL APPLY FOR A PERMIT 26
FROM THE BOARD BEFORE THE RELATED EVENT PROMOTER MAY PUBLICIZE, SELL 27
TICKETS FOR, ORGANIZE, OPERATE, PRODUCE, OR STAGE A RELATED EVENT. 28

(2) A HOLDER OF A STATE CATERER ’S LICENSE SHALL OBTA IN A 29
CLASS C PER DIEM BEER, BEER AND WINE, OR BEER, WINE, AND LIQUOR LICENSE 30

FROM THE BOARD BEFORE THE HOLD ER MAY ACT AS A PART ICIPATING LICENSE 1
HOLDER AT A RELATED EVENT. 2

(D) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION , 3
THE BOARD MAY GRANT THE P ERMIT TO AN APPLICAN T WHO SUBMITS AN 4
APPLICATION TO THE BOARD AS PROVIDED UND ER TITLE 4 OF THIS ARTICLE AT 5
LEAST 30 DAYS BEFORE THE DATE OF THE RELATED EVENT. 6

(2) BEFORE BEING GRANTED THE PERMIT, AN APPLICANT SHALL: 7

(I) OBTAIN WRITTEN CONSE NT FROM A DESIGNEE O F VISIT 8
BALTIMORE; 9

(II) IF REQUIRED BASED ON THE TYPE OF PREMISES TO BE 10
USED: 11

1. OBTAIN A SPECIAL EVE NT PERMIT F ROM THE 12
BALTIMORE CITY DEPARTMENT OF TRANSPORTATION; AND 13

2. PROVIDE A COPY OF TH E SPECIAL EVENT PERMIT TO 14
THE BOARD; AND 15

(III) PROVIDE A COMPLETED APPLICATION THAT: 16

1. IS DATED AND NOTARIZ ED, AND SIGNED BY EACH 17
LICENSE HOLDER THAT WILL PARTICIPATE IN THE RELATED EVENT; 18

2. LISTS EACH PREMISES FOR WHICH THE RELATE D 19
EVENT WILL BE HELD; AND 20

3. IS ACCOMPANIED BY AN Y OTHER DOCUMENT THA T 21
THE BOARD REQUIRES. 22

(3) AN INDIVIDUAL WHO APPLIES FOR AND IS ISSUED THE PERMIT IS 23
NOT REQUIRED TO BE A RESIDENT OF OR REG ISTERED TO VOTE IN BALTIMORE 24
CITY. 25

(4) WITHIN 7 DAYS AFTER RECEIVING AN APPLICATION, THE BOARD 26
SHALL GRANT OR DENY THE PERMIT OR REQUES T MORE INFORMATION F ROM THE 27
APPLICANT. 28

(5) A PERMIT MAY NOT BE AL TERED WITHIN 14 DAYS BEFORE TH E 29
RELATED EVENT IS SCHEDULED TO TAKE PLACE. 30

(E) THE PERMIT AUTHORIZES THE RELATED EVENT PR OMOTER AND 1
PARTICIPATING LICENSE HOLDER TO CONDUCT A RELATED EVENT. 2

(F) THE PERMIT FOR EACH R ELATED EVENT MAY BE IN EFFECT FOR THE 3
TIME STATED ON THE S PECIAL EVENT PERMIT REQUIRE D UNDER SUBSECTION 4
(D)(2) OF THIS SECTION. 5

(G) THE BOARD MAY ADOPT REGUL ATIONS ESTABLISHING THE 6
REQUIREMENTS FOR: 7

(1) CONDUCTING A RELATED EVENT, INCLUDING HEALTH AND 8
SAFETY STANDARDS TO BE MET BY THE RELATE D EVENT PROMOTER AND 9
PARTICIPATING LICENSE HOLDER; AND 10

(2) PROVIDING PUBLIC NOT ICE OF A RELATED EVE NT AT THE 11
PREMISES OF PARTICIP ATING LICENSE HOLDER S BY THE RELATED EVE NT 12
PROMOTER OR PARTICIPATING LICENSE HOLDERS. 13

(H) (1) THE APPLICATION FEE I S $50, PAYABLE ON THE SUBMI SSION OF 14
THE APPLICATION. 15

(2) THE PERMIT FEE, PAYABLE WHEN THE PERMIT IS GRANTED, IS: 16

(I) $500, IF THE BALTIMORE CITY FIRE MARSHAL HAS 17
DETERMINED THAT THE MAXIMUM CAPACITY FOR THE PROPOSED LOCATION IS LESS 18
THAN 300 PERSONS; OR 19

(II) $1,500, IF THE BALTIMORE CITY FIRE MARSHAL HAS 20
DETERMINED THAT THE MAXIMUM CAPACITY FOR THE PROPOSED LOCATION IS 300 21
OR MORE PERSONS. 22

(E) (1) FOR THE OFFENSE OF PU BLICIZING, SELLING TICKETS OR 24
IMPOSING A COVER CHA RGE FOR , ORGANIZING, OPERATING, PRODUCING, 25
FACILITATING, OR STAGING A RELATED EVENT WITH THE KNOWLEDGE OR A REASON 26
TO KNOW THAT A RELAT ED EVENT PROMOTER ’S PERMIT REQUIRED UN DER § 27
12–1102.2 OF THIS TITLE HAS NO T BEEN OBTAINED, THE BOARD SHALL IMPOSE A 28
FINE OF NOT LESS THA N $1,000 AND NOT MORE THAN $3,000 OR SUSPEND THE 29
LICENSE OR BOTH. 30

(2) A PERSON WHO VIOLATES § 12–1102.2 OF THIS TITLE MAY NOT BE 31
GRANTED A RELATED EVENT PROMOTER’S PERMIT FOR AT LEAST 1 YEAR. 32

(F) FOR THE OFFENSE BY A HOLDER OF A STATE CATERER’S LICENSE OF 1
PARTICIPATING IN A CIAA BASKETBALL TOURNAMENT RELATED EVENT WITHOUT 2
FIRST OBTAINING A CLASS C PER DIEM BEER, BEER AND WINE, OR BEER, WINE, AND 3
LIQUOR LICENSE REQUI RED UNDER § 12–1102.2 OF THIS TITLE , THE EXECUTIVE 4
DIRECTOR SHALL IMPOSE A FINE OF NOT LESS T HAN $1,000 AND NOT MORE THAN 5
$3,000 OR SUSPEND THE STATE CATERER’S LICENSE OR BOTH. 6

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency 7
measure, is necessary for the immediate preservation of the public health or safety, has 8
been passed by a yea and nay vote supp orted by three–fifths of all the members elected to 9
each of the two Houses of the General Assembly, and shall take effect from the date it is 10
enacted. It shall remain effective through June 30, 2029, and, at the end of June 30, 2029, 11
this Act, with no further action required by the General Assembly, shall be abrogated and 12
of no further force and effect. 13
