AN ACT concerning 1
Health Insurance – Bulk Purchasing Pools for Prescription Drugs 2
FOR the purpose of authorizing certain insurers, nonprofit health service plans, and health 3
maintenance organizations to join bulk purchasing pools for prescription drugs; and 4
generally relating to health insurance and bulk purchasing pools for prescription 5
drugs. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13
Article – Insurance 14

(A) (1) THIS SECTION APPLIES TO: 16
(I) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 17
PROVIDE COVERAGE FOR PRESCRIPTION DRUGS AND DEVICES UNDER INDIVIDUAL, 18
GROUP, OR BLANKET HEALTH IN SURANCE POLICIES OR CONTRACTS THAT ARE 19
ISSUED OR DELIVERED IN THE STATE; AND 20

(II) HEALTH MAINTENANCE O RGANIZATIONS THAT PROVID E 1
COVERAGE FOR PRESCRIPTION DRUGS AND DEVICES UNDER INDIVIDUAL OR GROUP 2
CONTRACTS THAT ARE ISSUED OR DELIVERED IN THE STATE. 3
(2) AN INSURER, A NONPROFIT HEALTH SERVICE PLAN, OR A HEALTH 4
MAINTENANCE ORGANIZA TION THAT PROVIDES C OVERAGE FOR PRESCRIPTION 5
DRUGS AND DEVICES TH ROUGH A PHARMACY BEN EFITS MANAGER IS SUB JECT TO 6
THE REQUIREMENTS OF THIS SECTION. 7
(B) AN ENTITY SUBJECT TO THIS SECTION MAY JOIN A BULK PURCHASI NG 8
POOL FOR PRESCRIPTION DRUGS. 9
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 10
October 1, 2026. 11
