AN ACT concerning 1

Consumer Protection – Electronic Funds Transfers – Regulations 2
(Elder Fraud Prevention Act of 2026) 3

FOR the purpose of providing that certain electronic fund s transfers are subject to the 4
provisions of a certain federal law; and generally relating to regulations for electronic 5
funds transfers. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

(A) THIS SECTION APPLIES TO ANY FINANCIAL INSTITUTION OPERATING IN 16
THE STATE. 17

(B) CONSUMER WI RE TRANSFERS INVOLVI NG ELECTRONIC FUND S 18
TRANSFERS MADE ANCILLARY TO BANK–TO–BANK TRANSFERS VIA A WIRE SERVICE 19
SHALL BE SUBJECT TO THE PROVISIONS OF TH E FEDERAL ELECTRONIC FUNDS 20
TRANSFER ACT OF 1978 (U.S.C. 1693 ET SEQ.). 21

SECTION 2. AND BE IT FURTHER ENAC TED, That if this Act is held to be 1
inapplicable to federally chartered financial institutions, or financial institutions operating 2
in the State that are chartered outside the State, for any reason in a court of competent 3
jurisdiction, this Act, with no fu rther action required by the General Assembly, shall be 4
abrogated and of no further force and effect. 5

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 6
October 1, 2026. 7
