FOR the purpose of authorizing the Information Technology Investment Fund, at the 4
discretion of the Secretary of Information Technology, to be used for certain purposes 5
in connection with certain information technology agreements; and generally related 6
to the Information Technology Investment Fund. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 6
That the Laws of Maryland read as follows: 7

Article – State Finance and Procurement 8

3.5–309. 9

(a) There is an Information Technology Investment Fund. 10

(l) (1) Notwithstanding subsection (b) of this section and in accordance with 11
paragraph (2) of this subsection, money paid into the Fund under subsection (e)(2) of this 12
section: 13

(I) shall be used to support: 14

[(i)] 1. the State telecommunication and computer network 15
established under § 3.5 –404 of this title, including program d evelopment for these 16
activities; and 17

[(ii)] 2. the Statewide Public Safety Interoperability Radio 18
System, also known as Maryland First (first responder interoperable radio system team), 19
under Title 1, Subtitle 5 of the Public Safety Article; AND 20

(II) AT THE SECRETARY’S DISCRETION , MAY BE USED TO 21
SUPPORT STATE–OWNED COMMUNICATION SITES, COMMUNICATIONS FACILITIES, 22
AND TELECOMMUNICATIO NS EQUIPMENT USED IN CONNECTION WITH 23
INFORMATION TECHNOLO GY AGREEMENTS ENTERE D INTO UNDER § 3.5–307 OF 24
THIS SUBTITLE, INCLUDING PROGRAM MANAGEMENT FOR THESE ACTIVITIES. 25

(2) The Secretary may determine the portion of the money paid into the 26
Fund that shall be allocated to each program described in paragraph (1) of this subsection. 27

(3) (I) ON OR BEFORE JANUARY 15 EACH YEAR, THE SECRETARY 28
SHALL SUBMIT A REPOR T TO THE GENERAL ASSEMBLY, IN ACCORDANCE WITH § 29
2–1257 OF THE STATE GOVERNMENT ARTICLE, SPECIFYING THE AMOUNT OF MONEY 30
PAID INTO THE FUND THAT WAS ALLOCAT ED TO EACH PROGRAM D ESCRIBED IN 31
PARAGRAPH (1) OF THIS SUBSECTION. 32

(II) THE REPORT REQUIRED U NDER THIS PARAGRAPH SHALL 1
INCLUDE HOW FUNDS WERE ALLOCATED AT THE SECRETARY’S DISCRETION UNDER 2
PARAGRAPH (1)(II) OF THIS SUBSECTION. 3

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 4
1, 2026. It shall remain effective for a period of 5 years and, at the end of June 30, 2031, this 5
Act, with no further action required by the General Assembly, shall be abrogated and of no 6
further force and effect. 7
