FOR the purpose of requiring each county board of education to submit a certain report to 4
the Department of Planning and the Interagency Commission on School 5
Construction each year; prohibiting certain adequate public facilities ordinance s 6
from delaying the processing and completion of subdivision or site development 7
plans; authorizing certain adequate public facilities ordinances to delay the issuance 8
of final permits; and generally relating to school zones, school construction, and 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 21
That the Laws of Maryland read as follows: 22

(A) ON OR BEFORE JULY 1, 2026, AND EACH JULY 1 THEREAFTER, EACH 1
COUNTY BOARD SHALL SUBMIT A STUDENT RESIDENCY AND SCHOOL ZONES REPORT 2
TO THE DEPARTMENT OF PLANNING AND THE INTERAGENCY COMMISSION ON 3
SCHOOL CONSTRUCTION. 4

(B) (1) THE STUDENT RESIDENCY AND SCHOOL ZONES REP ORT SHALL 5
INCLUDE: 6

(I) THE SCHOOL ZONE BOUND ARIES AND ATTENDANCE AREA 7
MAP; 8

(II) THE LOCATIONS OF EACH STUDENT’S RESIDENCE; AND 9

(III) THE STATE–RATED CAPACITY, STUDENT POPULATION, AND 10
CAPACITY PERCENTAGE OF EACH SCHOOL IN THE COUNTY. 11

(2) THE REPORT MAY NOT IN CLUDE PERSONAL IDENT IFYING 12
INFORMATION OF A STUDENT. 13

(C) THE INTERAGENCY COMMISSION ON SCHOOL CONSTRUCTION SHALL 14
ADOPT REGULATIONS ES TABLISHING FORMATTIN G AND SUBMISSION 15
REQUIREMENTS FOR THE STUDENT RESIDENCY AND SCHOOL ZONES REPORT. 16

A COUNTY’S ADEQUATE PUBLIC FA CILITIES ORDINANCE T HAT RESTRICTS 19
HOUSING DEVELOPMENT ON THE BASIS OF SCHOOL CAPACITY: 20

(1) MAY NOT DELAY THE PR OCESSING AND COMPLET ION O F 21
SUBDIVISION OR SITE DEVELOPMENT PLANS; BUT 22

(2) MAY DELAY THE ISSUANCE OF FINAL PERMITS. 23

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 24
1, 2026. 25
