SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2
That the Laws of Maryland read as follows: 3

Article – Courts and Judicial Proceedings 4

7–302. 5

(e) (4) (i) Except as provided in pa ragraphs (5) and (6) of this subsection, 6
from the fines collected by a political subdivision as a result of violations enforced by speed 7
monitoring systems, work zone speed control systems, stop sign monitoring systems, school 8
bus monitoring cameras, bus l ane monitoring systems, or noise abatement monitoring 9
systems, a political subdivision: 10

1. May recover the costs of implementing and administering 11
the speed monitoring systems, work zone speed control systems, stop sign monitoring 12
systems, school bus monitoring cameras, bus lane monitoring systems, or noise abatement 13
monitoring systems; and 14

2. Subject to subparagraphs [(ii), (iii), and (iv) ] (II) 15
THROUGH (VIII) of this paragraph, may spend any remaining balance solely for public 16
safety purposes, including pedestrian or highway safety programs. 17

(ii) 1. For any fiscal year, if the balance remaining from the fines 18
collected by a political subdivision as a result of violations enforced by speed monitoring 19
systems, after the costs of implementing an d administering the systems are recovered in 20
accordance with subparagraph (i)1 of this paragraph, is greater than 10% of the total 21
revenues of the political subdivision for the fiscal year, the political subdivision shall remit 22
any funds that exceed 10% of the total revenues to the Comptroller. 23

2. The Comptroller shall deposit any money remitted under 24
this subparagraph to the General Fund of the State. 25

(iii) The fines collected by Prince George’s County as a result of 26
violations enforced by speed monitoring systems on Maryland Route 210 shall be remitted 27
to the Comptroller for distribution to the State Highway Administration to be used solely 28
to assist in covering the costs of: 29

1. Examining the engineering, infrastructure, and other 30
relevant fa ctors that may contribute to safety issues on Maryland Route 210 in Prince 31
George’s County; 32

2. Reporting its findings and recommendations on any 33
solutions to these safety issues; and 34

3. Implementing any solutions to these safety issues. 35

(iv) 1. From the fines collected by Baltimore City as a result of 1
violations enforced by speed monitoring systems on Interstate 83, any balance remaining 2
after the allocation of fines under subparagraph (i)1 of this paragraph shall be remitted to 3
the Comptroller for distribution to the Baltimore City Department of Transportation to be 4
used solely to assist in covering the cost of roadway improvements on Interstate 83 in 5
Baltimore City. 6

2. Fines remitted to the Baltimore City Department of 7
Transportation under subsubparagraph 1 of this subparagraph are supplemental to and 8
are not intended to take the place of funding that would otherwise be appropriated for uses 9
described under subsubparagraph 1 of this subparagraph. 10

(v) From the fines collected by Anne A rundel County as a result of 11
violations enforced by speed monitoring systems on Maryland Route 175 (Jessup Road) 12
between the Maryland Route 175/295 interchange and the Anne Arundel County–Howard 13
County line, any balance remaining after the allocation of fines under subparagraph (i)1 of 14
this paragraph shall be remitted to the Comptroller for distribution to the State Highway 15
Administration to be used solely to assist in covering the cost of speed reduction measures 16
and roadway and pedestrian safety improveme nts on Maryland Route 175 (Jessup Road) 17
between the Maryland Route 175/295 interchange and the Anne Arundel County–Howard 18
County line. 19

(vi) From the fines collected by the Town of Oxford as a result of 20
violations enforced by speed monitoring systems at the intersection of Maryland Route 333 21
(Oxford Road) and Bonfield Avenue in Talbot County, any balance remaining after the 22
allocation of fines under subparagraph (i)1 of this paragraph shall be remitted to the 23
Comptroller for distribution to the State Highway Administration to be used solely to assist 24
in covering the cost of roadway and pedestrian safety improvements in and around the 25
intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue. 26

(vii) 1. From the fines collected by Montgomery County as a result 27
of violations enforced by speed monitoring systems placed in accordance with § 28
21–809(b)(1)(vi)7 of the Transportation Article, any balance remaining after the allocation 29
of fines under subparagraph (i)1 of this paragraph shall be used to fund the study, design, 30
and construction of safety –related projects on roadways or intersections in Montgomery 31
County that have been identified in the county’s or State’s most recent Strategic Highway 32
Safety Plan or Vision Zero Plan as roadways or intersections that are at high risk for motor 33
vehicle crashes that result in serious bodily injury or death. 34

2. From the fines collected by a municipal government in 35
Montgomery County as a result of violations enforced by speed monitoring systems placed 36
in accordance with § 21–809(b)(1)(vi)7 of the Transportation Article, any balance remaining 37
after the allocation of fines under subparagraph (i)1 of this paragraph shall be used to fund 38
the study, design, and construction of safety–related projects on roadways or intersections 39
in the municipality that have been identified in the municipality’s, county’s, or State’s most 40
recent Strategic Highway Safety Plan, Vision Zero Plan, or similar road safety plan as 41

roadways or intersections that are at high risk for mot or vehicle crashes that result in 1
serious bodily injury or death. 2

(VIII) FROM THE FINES COLLEC TED BY PRINCE GEORGE’S 3
COUNTY AS A RESULT OF VIOLATIONS ENFORCED BY SPEED MONITORING SYSTEMS 4
ON MARYLAND ROUTE 5 IN PRINCE GEORGE’S COUNTY, ANY BALANCE REMAINING 5
AFTER THE ALLOCATION OF FINES UNDER SUBPARAGRAPH (I)1 OF THIS PARAGRAPH 6
SHALL BE REMITTED TO THE COMPTROLLER FOR DISTR IBUTION TO THE STATE 7
HIGHWAY ADMINISTRATION TO BE USED, IN CONSULTATION WITH PRINCE 8
GEORGE’S COUNTY, SOLELY FOR STATE AND LOCAL HIGHW AY AND PEDESTRIAN 9
SAFETY IMPROVEMENTS ON AND IN THE VICINI TY OF MARYLAND ROUTE 5 IN 10
PRINCE GEORGE’S COUNTY. 11

Article – Transportation 12

21–809. 13

(a) (1) In this section the following words have the meanings indicated. 14

(9) “Speed monitoring system” means a device with one or more motor 15
vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 16
miles per hour above the posted speed limit. 17

(b) (1) (i) 1. A speed monitoring system may not be used by a local 18
jurisdiction under this section unless its use is authorized by the governing body of the local 19
jurisdiction by local law enacted after reasonable notice and a public hearing. 20

2. The State Highway Administration may use speed 21
monitoring systems on Interstate 83 in Baltimore County and Interstate 695 in Baltimore 22
County in accordance with this section. 23

3. The Maryland Transportation Authority may use speed 24
monitoring systems on Maryland Route 200 (Intercounty Connector) in accordance with 25
this section. 26

(v) An ordinance or resolution adopted by the governing body of a 27
local jurisdiction under this paragraph shall provide that, if the local jurisdiction moves or 28
places a mobile or stationary speed monitoring system to or at a location where a speed 29
monitoring system had not previously been moved or placed, the local jurisdiction may not 30
issue a citation for a violation recorded by that speed monitoring system: 31

1. Until signage is installed in accordance with 32
subparagraph (viii) of this paragraph; and 33

2. For at least the first 15 calendar days after the signage is 34
installed. 35

(vi) This section applies to a violation of this subtitle recorded by a 1
speed monitoring system that meets the requirements of this subsection and has been 2
placed: 3

1. In Anne Arundel County, Montgomery County, or Prince 4
George’s County, on a highway in a residential district, as defined in § 21–101 of this title, 5
with a maximum posted speed limit of 35 miles per hour, which speed limit was established 6
using generally accepted traffic engineering practices; 7

2. In a school zone with a posted speed limit of at least 20 8
miles per hour; 9

3. In Prince George’s County: 10

A. Subject to subparagraph (vii)1 of this paragraph, on 11
Maryland Route 210 (Indian Head Highway); [or] 12

B. ON MARYLAND ROUTE 5; OR 13

C. On that part of a highway located wi thin the grounds of 14
an institution of higher education as defined in § 10 –101(h) of the Education Article, or 15
within one–half mile of the grounds of a building or property used by the institution of 16
higher education where generally accepted traffic and eng ineering practices indicate that 17
motor vehicle, pedestrian, or bicycle traffic is substantially generated or influenced by the 18
institution of higher education; 19

4. Subject to subparagraph (vii)2 of this paragraph, on 20
Interstate 83 in Baltimore City; 21

5. In Anne Arundel County, on Maryland Route 175 (Jessup 22
Road) between the Maryland Route 175/295 interchange and the Anne Arundel 23
County–Howard County line; 24

6. Subject to subparagraph (vii)3 of this paragraph, at the 25
intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue in Talbot County; 26

7. Subject to subparagraph (vii)4 of this paragraph, by the 27
State Highway Administration on Interstate 83 in Baltimore County or on Interstate 695 28
in Baltimore County; 29

8. By the Maryland T ransportation Authority on Maryland 30
Route 200 (Intercounty Connector) in Montgomery County; or 31

9. Subject to subparagraph (xii) of this paragraph, in 32
Montgomery County on a highway identified in the municipality’s, county’s, or State’s most 33

recent Strategic Highway Safety Plan or Vision Zero Plan as a highway that is at high risk 1
for motor vehicle crashes that result in serious bodily injury or death. 2

(vii) 1. Not more than six mobile or stationary speed monitoring 3
systems may be placed on Maryland Route 210 (Indian Head Highway). 4

2. A. Subject to subsubsubparagraph B of this 5
subsubparagraph, not more than four speed monitoring systems may be placed on 6
Interstate 83 in Baltimore City. 7

B. Not more than one speed monitoring system in each 8
direction may be in operation at the same time on Interstate 83 in Baltimore City. 9

3. Not more than one speed monitoring system may be placed 10
at the intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue in Talbot 11
County. 12

4. The State Highway Administration: 13

A. May place and use a speed monitoring system on 14
Interstate 83 in Baltimore County or Interstate 695 in Baltimore County under this section 15
only at a location it identifies as being at high risk for motor vehicle c rashes that result in 16
death or serious bodily injury; 17

B. I. May not place or use more than three speed 18
monitoring systems in each direction on Interstate 83 in Baltimore County; and 19

II. May not place or use more than four speed monitoring 20
systems in each direction on Interstate 695 in Baltimore County; and 21

C. May not place or use a speed monitoring system 22
authorized under this section within 5 miles of another speed monitoring system authorized 23
under this section operating in the same direction. 24

(viii) Before activating a speed monitoring system, the local 25
jurisdiction, the State Highway Administration, or the Maryland Transportation 26
Authority, as appropriate, shall: 27

1. Publish notice of the location of the speed monitoring 28
system on its website and in a newspaper of general circulation in the jurisdiction; 29

2. Ensure that each sign that designates a school zone is 30
proximate to a sign that: 31

A. Indicates that speed monitoring systems are in use in the 32
school zone; and 33

B. Is in accordance with the manual for and the specifications 1
for a uniform system of traffic control devices adopted by the State Highway Administration 2
under § 25–104 of this article; 3

3. With regard to a speed monitoring system established on 4
Maryland Route 210 (Indian Head Highway) OR MARYLAND ROUTE 5 in Prince George’s 5
County, based on proximity to an institution of higher education under subparagraph (vi)3 6
of this paragraph, on Interstate 83 in Baltimore City, in Anne Arundel County on Maryland 7
Route 175 (Jessup Road) between the Maryland Route 175/295 interchange and the Anne 8
Arundel County–Howard County line, at the intersection of Maryland Route 333 (Oxford 9
Road) and Bonfield Avenue in Talbot County, on Interstate 83 in Baltimore County or 10
Interstate 695 in Baltimore County, or on Maryland Route 200 (Intercounty Connector) in 11
Montgomery County, ensure that all speed limit signs approaching and within the segment 12
of highway on which the speed monitoring system is located include signs that: 13

A. Are in accordance with the manual and specifications for 14
a uniform system of traffic control devices adopted by the State Highway Administration 15
under § 25–104 of this article; and 16

B. Indicate that a speed monitoring system is in use; and 17

4. With regard to a speed monitoring system placed on 18
Maryland Route 210 (Indian Head Highway) OR MARYLAND ROUTE 5 in Prince George’s 19
County, Interstate 83 in Baltimore City, in Anne Arundel County on Maryland Route 175 20
(Jessup Road) between the Maryland Rout e 175/295 interchange and the Anne Arundel 21
County–Howard County line, at the intersection of Maryland Route 333 (Oxford Road) and 22
Bonfield Avenue in Talbot County, on Interstate 83 in Baltimore County or Interstate 695 23
in Baltimore County, or on Maryland Route 200 (Intercounty Connector) in Montgomery 24
County, ensure that each sign that indicates that a speed monitoring system is in use is 25
proximate to a device that displays a real –time posting of the speed at which a driver is 26
traveling. 27

(c) (1) Unless the driver of the motor vehicle received a citation from a police 28
officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 29
section, the driver of a motor vehicle is subject to a civil penalty if the mot or vehicle is 30
recorded by a speed monitoring system while being operated in violation of this subtitle. 31

(2) (i) Except as provided in subparagraphs (ii) and (iii) of this 32
paragraph, a civil penalty under this subsection may not exceed: 33

1. If the citation alleges that the driver of the motor vehicle 34
exceeded the speed limit by between 12 and 15, inclusive, miles per hour, $40; 35

2. If the citation alleges that the driver of the motor vehicle 36
exceeded the speed limit by between 16 and 19, inclusive, miles per hour, $70; 37

3. If the citation alleges that the driver of the motor vehicle 1
exceeded the speed limit by between 20 and 29, inclusive, miles per hour, $120; 2

4. If the citation alleges that the driver of the motor vehicle 3
exceeded the speed limit by between 30 and 39, inclusive, miles per hour, $230; and 4

5. If the citation alleges that the driver of the motor vehicle 5
exceeded the speed limit by 40 miles per hour or more, $425. 6

(ii) A civil penalty under this paragraph for a viola tion recorded on 7
Interstate 83 in Baltimore County or Interstate 695 in Baltimore County may not exceed 8
$40. 9

(iii) 1. This paragraph applies to a civil penalty assessed to the 10
owner or driver of a motor vehicle that is recorded by a speed monitoring s ystem while 11
being operated on Maryland Route 210 (Piscataway Highway) in Prince George’s County 12
in violation of this subtitle. 13

2. The maximum civil penalty under this subparagraph is as 14
follows: 15

A. For exceeding the maximum posted speed limit by 16
between 12 and 15, inclusive, miles per hour, $40; 17

B. For exceeding the maximum posted speed limit by 18
between 16 and 19, inclusive, miles per hour, $70; 19

C. For exceeding the maximum posted speed limit by 20
between 20 and 29, inclusive, miles per hour, $120; 21

D. For exceeding the maximum posted speed limit by 22
between 30 and 39, inclusive, miles per hour, $230; or 23

E. For exceeding the maximum posted speed limit by 40 24
miles per hour or more, $425. 25

(3) For purposes of this section, the District Court shall prescribe: 26

(i) A uniform citation form consistent with subsection (d)(1) of this 27
section and § 7–302 of the Courts Article; and 28

(ii) A civil penalty, which shall be indicated on the citation, to be paid 29
by persons who choose to prepay the civil penalty without appearing in District Court. 30

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 31
October 1, 2026. 32
