AN ACT concerning 1
Family Child Care Providers – National Guard and Military Reserves Reserve 2
Component Members – Substitute Provider 3
FOR the purpose of requiring a family child care provider who is a member of the National 4
Guard or military reserves a reserve component to designate a substitute to provide 5
family child care under certain circumstances for not more than a certain amount of 6
time each year; and generally relating to family child care providers. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

9.5–301. 1
(a) In this subtitle the following words have the meanings indicated. 2
(b) “Child care provider” means the adult who has primary responsibility for the 3
operation of a family child care home or a large family child care home. 4
(e) “Family child care home” means a residence in which family child care is 5
provided for up to eight children. 6
(f) “Family child care provider” means an individual who cares for children in a 7
registered family child care home or a registered large family child care home. 8

(A) IN THIS SECTION , “MILITARY RESERVES ” MEANS THE U.S. ARMY 10
RESERVE, U.S. NAVY RESERVE, AIR FORCE RESERVE COMMAND, U.S. MARINE 11
CORPS RESERVE, OR U.S. COAST GUARD RESERVE. 12
(B) THIS SECTION APPLIES ONLY TO A FAMILY CHILD CARE PROVIDER WHO 13
IS A MEMBER OF THE NATIONAL GUARD OR MILITARY RES ERVES A RESERVE 14
COMPONENT. 15
(C) (B) A FAMILY CHILD CARE PR OVIDER SHALL DE SIGNATE A 16
SUBSTITUTE TO PROVID E FAMILY CHILD CARE DURING THE FAMILY CH ILD CARE 17
PROVIDER’S ABSENCE FOR REQUIR ED TRAINING AND ACTI VE SERVICE IN THE 18
NATIONAL GUARD OR MILITARY RESERVES A RESERVE COMPONENT. 19
(D) (C) A FAMILY CARE PROVIDER UNDER SUBSECTION (C) (B) OF THIS 20
SECTION MAY USE THE DESIGNATED SUBSTITUTE TO PROVIDE FAMILY CHILD CARE 21
DURING THE FAMILY CH ILD CARE PROVIDER ’S ABSENCE FOR NOT MO RE THAN 45 22
WORKING DAYS IN ANY 12–MONTH PERIOD. 23
(D) THIS SECTION MAY NOT BE CONSTRUED TO OTHE RWISE LIMIT THE 24
AUTHORITY OF THE DEPARTMENT TO ESTABLISH REQUIREMENTS FOR: 25
(1) A FAMILY CHILD CARE PR OVIDER TO DESIGNATE A SUBSTITUTE 26
TO PROVIDE FAMILY CHILD CARE IN THE FAMILY CHILD CARE PROVIDER’S ABSENCE; 27
AND 28
(2) THE QUALIFICATIONS NECESSARY TO SERVE AS A SUBSTITUTE. 29
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 30
1, 2026. 31
