AN ACT concerning 1

Department of Juvenile Services – Employees – Prohibited Convictions 2
(Juvenile Offender Protection Act) 3

FOR the purpose of prohibiting the Department of Juvenile Services from hiring or 4
retaining an individual convicted of a certain crime; and generally relating to the 5
Department of Juvenile Services. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

Article – Human Services 14

9–209.1. 15

(A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION , THE 16
DEPARTMENT MAY NOT KN OWINGLY HIRE OR RETAIN ANY INDIVIDUA L WHO HAS 17
BEEN CONVICTED OF: 18

(1) ABDUCTION; 19

(2) KIDNAPPING; 1

(3) MANSLAUGHTER, EXCEPT INVOLUNTARY MANSLAUGHTER; 2

(4) MURDER; 3

(5) RAPE; 4

(6) SEXUAL OFFENSE IN THE FIRST DEGREE OR SECOND DEGREE; 5

(7) CHILD ABUSE IN THE FIRST DEGREE UNDER § 3–601 OF THE 6
CRIMINAL LAW ARTICLE; 7

(8) SEXUAL ABUSE OF A MI NOR UNDER § 3–602 OF THE CRIMINAL 8
LAW ARTICLE; 9

(9) A FELONY OFFENSE UND ER TITLE 3, SUBTITLE 11 OF THE 10
CRIMINAL LAW ARTICLE; 11

(10) CONTINUING COURSE OF CONDUCT WITH A CHILD UNDER § 3–315 12
OF THE CRIMINAL LAW ARTICLE; 13

(11) ASSAULT IN THE FIRST DEGREE; 14

(12) ASSAULT WITH INTENT TO MURDER; 15

(13) ASSAULT WITH INTENT TO RAPE; OR 16

(14) ASSAULT WITH INTENT TO COMMIT A SEXUAL O FFENSE IN THE 17
FIRST DEGREE OR SECOND DEGREE. 18

(B) THE DEPARTMENT MAY HIRE OR RETAIN AN INDIVIDUAL CONVICTED OF 19
A CRIME LISTED UNDER SUBSECTION (A) OF THIS SECTION IF T HE JUDGMENT OF 20
CONVICTION FOR THE CRIME WAS REVERSED OR VACATED. 21

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take eff ect 22
October 1, 2026. 23
