FOR the purpose of clarifying that certain requirements apply only to districts for the 3
election of members of the Senate of Maryland and the House of Delegates; 4
authorizing the General Assembly to grant original jurisdiction to the Supreme 5
Court of Maryland to re view the congressional districting of the State; altering 6
districts for the election of Representatives in Congress for certain elections; and 7
generally relating to election districts. 8

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 9
That: 10

(a) Notwithstanding Title 8, Subtitle 7 of th e Election Law Article, the 11
congressional districting plan set forth in this section shall be used to elect the State’s 12
Representatives in Congress from the State’s eight congressional districts in 2026. 13

(b) (1) The descriptions of congressional district s in this section include the 14
references indicated. 15

(2) (i) The references to: 16

1. election districts and wards are to the geographical 17
boundaries of the election districts and wards as they existed on January 13, 2026; and 18

2. precincts are to the geographical boundaries of the 19
precincts as they existed on January 13, 2026, and as reviewed and corrected by the 20
Maryland Department of Planning. 21

(ii) Where precincts are split between congressional districts, census 22
tract and block numbers, as i ndicated in P.L. 94 –171 data or shown on the P.L. 94 –171 23
census block maps provided by the U.S. Bureau of the Census and referred to in this 24
subtitle, are used to define the boundaries of congressional districts. 25

(c) (1) The first congressional district consists of the following counties: 26

(i) Caroline County; 27

(ii) Dorchester County; 28

(iii) Kent County; 29

(iv) Queen Anne’s County; 30

(v) Somerset County; 31

(vii) Wicomico County; and 2

(viii) Worcester County. 3

(2) The district also includes the following parts of Anne Arundel County: 4

(iii) election district 2, precincts 1, 4, 9, 21, 23, and 24; 7

SECTION 3. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 3
That Section(s) 8 –702 through 8 –709 of Article – Election Law of the Annotated Code of 4
Maryland be repealed. 5

SECTION 4. AND BE IT FURTHER ENACTED, That the General Assembly 6
determines that the amendment to the Maryland Constitution proposed by Section 2 of this 7
Act affects multiple jurisdictions and that the provisions of Article XIV, § 1 of the Maryland 8
Constitution concerning local approval of constitutional amendments do not apply. 9

SECTION 5. AND BE IT FURTHER ENACTED, That: 10

(a) The amendment to the Maryland Constitution proposed by Section 2 of this 11
Act shall be submitted to the qualified voters of the State at the next general election to be 12
held in November 2026 for adoption or rejection in accordance with Article XIV of the 13
Maryland Constitution. 14

(b) (1) At that general election, the vote on the proposed amendment to the 15
Constitution shall be by ballot, and on each ballot there shall be printed the words “For the 16
Constitutional Amendment” and “Against the Constitutional Amendment”, as now 17
provided by law. 18

(2) At that general election, a question substantially similar to the 19
following shall be submitted to the qualified voters of the State: 20

“Question ___ – Constitutional Amendment 21

The proposed Constitutional Amendment authorizes the use of the Congressional 22
Districting Plan enacted by the General Assembly in 2026 for the 2028 and 2030 23
congressional elections and until a new Congressional Districting Plan takes effect after 24
the 2030 census; and authorizes the General Assembly to grant original jurisdiction to the 25
Supreme Court of Maryland to review the congressional districting of the State; and 26
clarifies that certain standard s in the Maryland Constitution apply only to districts used 27
to elect members of the General Assembly.”. 28

(c) Immediately after the election, all returns shall be made to the Governor of 29
the vote for and against the proposed amendment, as directed by Artic le XIV of the 30
Maryland Constitution, and further proceedings held in accordance with Article XIV. 31

SECTION 6. AND BE IT FURTHER ENACTED, That Section 3 of this Act is 32
contingent on the passage of Section 2 of this Act, a constitutional amendment, and its 33
ratification by voters of the State. 34

SECTION 7. AND BE IT FURTHER ENACTED, That, subject to Section 6 of this 1
Act, Section 3 of this Act shall take effect on the proclamation of the Governor that the 2
constitutional amendment, having received a majority o f the votes cast at the general 3
election has been adopted by the people of Maryland. 4

SECTION 8. AND BE IT FURTHER ENACTED, That, subject to Section 5 of this 5
Act and except as provided in Section 7 of this Act, this Act is an emergency measure, is 6
necessary for the immediate preservation of the public health or safety, has been passed by 7
a yea and nay vote supported by three–fifths of all the members elected to each of the two 8
Houses of the General Assembly, and shall take effect from the date it is enacted. 9
