FOR the purpose of requiring the Motor Vehicle Administration to enter into an agreement 3

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 3
That the Laws of Maryland read as follows: 4

Article – Transportation 5

12–415. 6

(A) THE ADMINISTRATION SHALL ENT ER INTO AN AGREEMENT OR 7
ARRANGEMENT WITH AN APPROPRIATE AUTHORIZ ED REPRESENTATIVE OF THE 8
COMMONWEALTH OF VIRGINIA TO OBTAIN AND REGULARLY UPDATE INFORMATION 9
REGARDING MOTOR VEHICLES THAT: 10

(1) ARE OWNED BY RESIDENTS OF THE STATE; AND 11

(2) ARE IMPROPERLY REGIST ERED IN THE COMMONWEALTH OF 12
VIRGINIA. 13

(B) THE ADMINISTRATION SHALL: 14

(1) COMPILE THE INFORMATI ON OBTAINED UNDER TH IS SECTION 15
INTO A SEARCHABLE DATABASE; AND 16

(2) MAKE THE DATABASE AVA ILABLE TO ANY STATE OR LOCAL 17
ENTITY SEEKING ACCESS FOR THE PURPOSE OF ISSUING CITATIONS TO THE OWNERS 18
OR DRIVERS OF MOTOR VEHICLES FOR VIOLATIONS RECORDED BY: 19

(I) SPEED MONITORING SYST EMS UNDER § 21–809 OF THIS 20
ARTICLE; AND 21

(II) WORK ZONE SPEED CONTROL SYSTEMS UNDER § 21–810 OF 22
THIS ARTICLE. 23

21–809. 24

(a) (1) In this section the following words have the meanings indicated. 25

(9) “Speed monitoring system” means a device with one or more motor 26
vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 27
miles per hour above the posted speed limit. 28

(c) (1) Unless the driver of the motor vehicle received a citation from a police 29
officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 30

section, the driver of a motor ve hicle is subject to a civil penalty if the motor vehicle is 1
recorded by a speed monitoring system while being operated in violation of this subtitle. 2

(2) (i) Except as provided in subparagraphs (ii) [and], (iii), AND (IV) of 3
this paragraph, a civil penalty under this subsection may not exceed: 4

1. If the citation alleges that the driver of the motor vehicle 5
exceeded the speed limit by between 12 and 15, inclusive, miles per hour, $40; 6

2. If the citation alleges th at the driver of the motor vehicle 7
exceeded the speed limit by between 16 and 19, inclusive, miles per hour, $70; 8

3. If the citation alleges that the driver of the motor vehicle 9
exceeded the speed limit by between 20 and 29, inclusive, miles per hour, $120; 10

4. If the citation alleges that the driver of the motor vehicle 11
exceeded the speed limit by between 30 and 39, inclusive, miles per hour, $230; and 12

5. If the citation alleges that the driver of the motor vehicle 13
exceeded the speed limit by 40 miles per hour or more, $425. 14

(ii) A civil penalty under this paragraph for a violation recorded on 15
Interstate 83 in Baltimore County or Interstate 695 in Baltimore County may not exceed 16
$40. 17

(iii) 1. This paragraph applies to a civil penalty a ssessed to the 18
owner or driver of a motor vehicle that is recorded by a speed monitoring system while 19
being operated on Maryland Route 210 (Piscataway Highway) in Prince George’s County 20
in violation of this subtitle. 21

2. [The] EXCEPT AS PROVIDED IN SUBPARAGRAPH (IV) 22
OF THIS PARAGRAPH, THE maximum civil penalty under this subparagraph is as follows: 23

A. For exceeding the maximum posted speed limit by 24
between 12 and 15, inclusive, miles per hour, $40; 25

B. For exceeding the maximum posted speed lim it by 26
between 16 and 19, inclusive, miles per hour, $70; 27

C. For exceeding the maximum posted speed limit by 28
between 20 and 29, inclusive, miles per hour, $120; 29

D. For exceeding the maximum posted speed limit by 30
between 30 and 39, inclusive, miles per hour, $230; or 31

E. For exceeding the maximum posted speed limit by 40 32
miles per hour or more, $425. 33

(IV) 1. THIS PARAGRAPH APPLIE S TO A CIVIL PENALTY 1
ASSESSED TO THE OWNER OR DRIVER OF A MOTOR VEHICLE THAT IS RECORDED BY 2
A SPEED MONITORING S YSTEM WHILE BEING OPER ATED IN VIOLATION OF THIS 3
SUBTITLE, IF: 4

A. THE OWNER OF THE MOTO R VEHICLE IS A RESID ENT 5
OF THE STATE; AND 6

B. THE MOTOR VEHICLE IS IMPROPERLY REGISTERED IN 7
THE COMMONWEALTH OF VIRGINIA. 8

2. THE MAXIMUM CIVIL PEN ALTY UNDER THIS 9
SUBPARAGRAPH IS: 10

A. FOR EXCEEDING THE MAXIMUM POSTED SPEED LIMIT 11
BY BETWEEN 12 AND 15, INCLUSIVE, MILES PER HOUR, $250; 12

B. FOR EXCEEDING THE MAXIMUM POSTED SPEED LIMIT 13
BY BETWEEN 16 AND 19, INCLUSIVE, MILES PER HOUR, $500; 14

C. FOR EXCEEDING THE MAXIMUM POSTED SPEED LIMIT 15
BY BETWEEN 20 AND 29, INCLUSIVE, MILES PER HOUR, $750; 16

D. FOR EXCEEDING THE MAXIMUM POSTED SPEED LIMIT 17
BY BETWEEN 30 AND 39, INCLUSIVE, MILES PER HOUR, $1,000; OR 18

E. FOR EXCEEDING THE MAXIMUM POSTED SPEED LIMIT 19
BY 40 MILES PER HOUR OR MORE, $1,250. 20

(3) For purposes of this section, the District Court shall prescribe: 21

(i) A uniform citation form consistent with subsection (d)(1) of this 22
section and § 7–302 of the Courts Article; and 23

(ii) A civil penalty, which shall be indicated on the citation, to be paid 24
by persons who choose to prepay the civil penalty without appearing in District Court. 25

(d) (1) Subject to the provisions of paragraphs (2) through (4) of this 26
subsection, an agency shall mail t o an owner liable under subsection (c) of this section a 27
citation that shall include: 28

(i) The name and address of the registered owner of the vehicle; 29

(ii) The registration number of the motor vehicle involved in the 1
violation; 2

(iii) The violation charged; 3

(iv) The location where the violation occurred; 4

(v) The date and time of the violation; 5

(vi) A copy of the recorded image; 6

(vii) The amount of the civil penalty imposed and the date by which 7
the civil penalty should be paid; 8

(viii) A signed statement by a duly authorized law enforcement officer 9
or a technician employed by or under contract with an agency that, based on inspection of 10
recorded images, the motor vehicle was being operated in violation of this subtitle; 11

(ix) A statement that recorded images are evidence of a violation of 12
this subtitle; 13

(x) Information advising the person alleged to be liable under this 14
section of the manner and time in which liability as alleged in the citation may be contested 15
in the District Court; [and] 16

(xi) Information advising the person alleged to be liable under this 17
section that failure to pay the civil penalty or to contest liability in a timely manner: 18

1. Is an admission of liability; 19

2. May result in the refusal by the Administration to register 20
the motor vehicle; and 21

3. May result in the suspension of the motor vehicle 22
registration; AND 23

(XII) IF THE OWNER OF THE M OTOR VEHICLE IS A RE SIDENT OF 24
THE STATE AND THE MOTOR V EHICLE IS IMPROPERLY REGISTERED IN THE 25
COMMONWEALTH OF VIRGINIA, INFORMATION ADVISING THE PERSON ALLEGED TO 26
BE LIABLE UNDER THIS SECTION THAT DRIVING A MOTOR VEHICLE ON A HIGHWAY 27
WITHOUT PROPER REGISTRATION IS A VIOLATION OF § 13–402 OF THIS ARTICLE. 28

(a) (1) In this section the following words have the meanings indicated. 30

(7) “Work zone speed control system” means a device that: 1

(i) Has one or more motor vehicle sensors connected to a camera 2
system capable of producing recorded images of motor vehicles traveling at or abov e a 3
predetermined speed in or approaching a work zone; and 4

(ii) Is equipped with flashing blue lights. 5

(c) (1) Unless the driver of the motor vehicle received a citation from a police 6
officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 7
section, the driver of a motor vehicle is subject to a civil penalty if an image of the motor 8
vehicle is recorded by a work zone speed control system in accordance with subsection (b) 9
of this section while being operated in violation of this subtitle. 10

(2) Except as provided in [paragraph] PARAGRAPHS (3) AND (4) of this 11
subsection, a civil penalty under this subsection is: 12

(i) If the citation alleges that the driver of the motor vehicle 13
exceeded the speed limit by between 12 and 15, inclusive, miles per hour, $60; 14

(ii) If the citation alleges that the driver of the motor vehicle 15
exceeded the speed limit by between 16 and 19, inclusive, miles per hour, $80; 16

(iii) If the citation alleges that the driver of the motor vehicle 17
exceeded the speed limit by between 20 and 29, inclusive, miles per hour, $140; 18

(iv) If the citation alleges that the driver of the motor vehicle 19
exceeded the speed limit by between 30 and 39, inclusive, miles per hour, $270; AND 20

(v) If th e citation alleges that the driver of the motor vehicle 21
exceeded the speed limit by 40 miles per hour or more, $500. 22

(3) (I) THIS PARAGRAPH APPLIES TO A CIVIL PENALTY ASSESSED 23
TO THE OWNER OR DRIV ER OF A MOTOR VEHICL E THAT IS RECORDED B Y A WORK 24
ZONE SPE ED CONTROL SYSTEM WH ILE BEING OPERATED I N VIOLATION OF THIS 25
SUBTITLE, IF: 26

1. THE OWNER OF THE MOTO R VEHICLE IS A RESID ENT 27
OF THE STATE; AND 28

2. THE MOTOR VEHICLE IS IMPROPERLY REGISTERED IN 29
THE COMMONWEALTH OF VIRGINIA. 30

(II) EXCEPT AS PROVIDED IN PARAGRAPH (4) OF THIS 31
SUBSECTION, A CIVIL PENALTY UNDER THIS SUBSECTION IS: 32

1. IF THE CITATION ALLEGES THAT THE DRIVER OF THE 1
MOTOR VEHICLE EXCEEDED THE SPEED LIMIT BY BETWEEN 12 AND 15, INCLUSIVE, 2
MILES PER HOUR, $300; 3

2. IF THE CITATION ALLEGES THAT THE DRIVER OF THE 4
MOTOR VEHICLE EXCEEDED THE SPEED LIMIT BY BETWEEN 16 AND 19, INCLUSIVE, 5
MILES PER HOUR, $450; 6

3. IF THE CITATION ALLEGES THAT THE DRIVER OF THE 7
MOTOR VEHICLE EXCEEDED THE SPEED LIMIT BY BETWEEN 20 AND 29, INCLUSIVE, 8
MILES PER HOUR, $600; 9

4. IF THE CITATION ALLEGES THAT THE DRIVER OF THE 10
MOTOR VEHICLE EXCEEDED THE SPEED LIMIT BY BETWEEN 30 AND 39, INCLUSIVE, 11
MILES PER HOUR, $750; AND 12

5. IF THE CITATION ALLEGES THAT THE DRIVER OF THE 13
MOTOR VEHICLE EXCEED ED THE SPEED LIMIT BY 40 MILES PER HOUR OR MO RE, 14
$900. 15

(4) If a citation is for a violation recorded when workers were present in 16
the work zone, the civil penalty shall be double the amount that would otherwise apply 17
under paragraph (2) OR (3) of this subsection. 18

[(4)] (5) For purposes of this section, the District Court shall: 19

(i) Prescribe a uniform citation form consistent with subsection 20
(d)(1) of this section and § 7–302 of the Courts Article; and 21

(ii) Indicate on the citation the amount of the civil penalty to be paid 22
by persons who choose to prepay the civil penalty without appearing in District Court. 23

(d) (1) Subject to the provisions of paragraphs (2) through (4) of this 24
subsection, a local police department, State police department, or police de partment 25
contractor shall mail to the owner liable under subsection (c) of this section a citation that 26
shall include: 27

(i) The name and address of the registered owner of the vehicle; 28

(ii) The registration number of the motor vehicle involved in th e 29
violation; 30

(iii) The violation charged; 31

(iv) The location where the violation occurred; 32

(v) The date and time of the violation; 1

(vi) At least one recorded image of the vehicle with a data bar 2
imprinted on each image that includes the speed of the vehicle and the date and time the 3
image was recorded; 4

(vii) The amount of the civil penalty imposed and the date by which 5
the civil penalty should be paid; 6

(viii) A signed statement by a police officer employed by the local police 7
department or State police department that, based on inspection of recorded images, the 8
motor vehicle was being operated in violation of this subtitle; 9

(ix) A statement that recorded images are evidence of a violation of 10
this subtitle; 11

(x) Information advising the person alleged to be liable under this 12
section of the manner and time in which liability as alleged in the citation may be contested 13
in the District Court; [and] 14

(xi) Information advising the person alleged to be liable under this 15
section that failure to pay the civil penalty or to contest liability in a timely manner: 16

1. Is an admission of liability; 17

2. May result in the refusal to register the motor vehicle; and 18

3. May result in the suspension of the motor vehicle 19
registration; AND 20

(XII) IF THE OWNER OF THE M OTOR VEHICLE IS A RE SIDENT OF 21
THE STATE AND THE MOTOR V EHICLE IS IMPROPERLY REGISTERED IN THE 22
COMMONWEALTH OF VIRGINIA, INFORMATION ADVISING THE PERSON ALLEGED TO 23
BE LIABLE UNDER THIS SECTION THAT DRIVING A MOTOR VEHICLE ON A HIGHWAY 24
WITHOUT PROPER REGISTRATION IS A VIOLATION OF § 13–402 OF THIS ARTICLE. 25

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 26
October 1, 2026. 27
