Coverage and Prohibited Cost Sharing 3

FOR the purpose of requiring certain insurers, nonprofit health service plans, and health 4
maintenance organizations to provide individuals with coverage for opportunistic 5
salpingectomy coverage for ovarian cancer prevention; prohibiting the insurers, 6
nonprofit health service plans, and health maintenance organizations from imposing 7
a copayment, coinsurance, or deductible requirement on the salpingectomy coverage; 8
and generally relating to insurance coverage for salpingectomies for ovarian cancer 9
prevention. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

(A) THIS SECTION APPLIES TO: 1

(1) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 2
PROVIDE HOSPITAL, MEDICAL, OR SURGICAL BENEFITS TO INDIVIDUALS OR GROUPS 3
ON AN EXPENSE–INCURRED BASIS UNDER HEALTH INSURANCE POLICIES THAT ARE 4
ISSUED OR DELIVERED IN THE STATE; AND 5

(2) HEALTH MAINTENANCE O RGANIZATIONS THAT PR OVIDE 6
HOSPITAL, MEDICAL, OR SURGICAL BENEFITS TO INDIVIDUALS OR GROUPS UNDER 7
CONTRACTS THAT ARE ISSUED OR DELIVERED IN THE STATE. 8

(B) AN ENTITY SUBJECT TO THIS SECTION SHALL PROVIDE AN INDIVIDUAL 9
WITH COVERAGE FOR OPPORTU NISTIC SALPINGECTOMY COVERAGE FOR OVARIAN 10
CANCER PREVENTION. 11

(C) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION , 12
AN ENTITY SUBJECT TO THIS SECTION MAY NOT IMPOSE A COPAYMENT , 13
COINSURANCE, OR DEDUCTIBLE REQUIREME NT ON SALPINGECTOMY COVERAGE 14
FOR OVARIAN CANCER PREVENTION. 15

(2) IF AN INSURED OR ENRO LLEE IS COVERED UNDE R A 16
HIGH–DEDUCTIBLE HEALTH PL AN, AS DEFINED IN 26 U.S.C. § 223, AN ENTITY 17
SUBJECT TO THIS SECT ION MAY SUBJECT SALP INGECTOMY COV ERAGE FOR 18
OVARIAN CANCER PREVE NTION TO THE DEDUCTI BLE REQUIREMENT OF T HE 19
HIGH–DEDUCTIBLE PLAN. 20

SECTION 2. AND BE IT FURTHER ENACTED, That Section 1 of this Act shall 21
apply to all policies, contracts, and health benefit plans issued, delivered, or renewed in the 22
State on or after January 1, 2027. 23

SECTION 3. AND BE IT FURTHER ENACTED, That, on or before December 1, 24
2026, the Maryland Health Care Commission shall: 25

(1) conduct a mandated benefits study of coverage of salpingectomy that is 26
not opportunistic for individuals who are not at high risk of ovarian cancer, including 27
consideration of existing practice guidance issued by the American College of Obstetricians 28
and Gynecologists and the Society of Gynecologic Oncology as well as the differences in 29
efficacy of nonopportunistic salpingectomy versus the efficacy of opportunistic 30
salpingectomy for individuals who are not at high risk; and 31

(2) report the findings of the study to the Senate Finance Committee and 32
the House Health Committee, in accordance with § 2–1257 of the State Government Article. 33

SECTION 3. 4. AND BE IT FURTHER ENACTED, That Sections 1 and 2 this Act 1
shall take effect January 1, 2027. 2

SECTION 5. AND BE IT FURTHER ENACTED, That, except as provided in 3
Section 4 of this Act, this Act shall take effect July 1, 2026. 4
