AN ACT concerning 1

Correctional Services – Immigration Enforcement – Required Notice and 2
Transfer 3

FOR the purpose of requiring an employee or agent of a State or local correctional facility 4
to provide certain notice of the release of a n individual and transfer the individual 5
to federal immigration authorities under certain circumstances ; and generally 6
relating to immigration enforcement. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14

IF REQUESTED BY FEDERAL IMMIGRATI ON AUTHORITIES, AN EMPLOYEE OR 17
AGENT OF A STATE OR LOCAL CORRECTIONAL FACILITY SHALL: 18

(1) PROVIDE NOTICE OF TH E RELEASE OF AN INDIVIDUAL AT LEAST 19
48 HOURS PRIOR TO THE R ELEASE OF THE INDIVI DUAL IN ORDER TO FAC ILITATE 20
THE TRANSFER OF THE INDIVIDUAL TO FEDERAL IMMIGRATION AUTHORITIES; AND 21

(2) TRANSFER THE INDIVIDUAL TO FEDERA L IMMIGRATION 1
AUTHORITIES PROVIDED THAT THE TRANSFER DO ES NOT EXTEND THE TI ME IN 2
CUSTODY OF THE INDIVIDUAL BEYOND THE INDIVIDUAL’S SCHEDULED RELEASE. 3

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 4
October 1, 2026. 5
