A BILL ENTITLED

AN ACT concerning 1

Speed Monitoring Systems – Citations – Failure to Pay 2

FOR the purpose of repealing a requirement that a citation issued for a violation recorded 3
by a speed monitoring system include information advising that a failure to pa y or 4
contest liability is an admission of liability ; and generally relating to citations and 5
speed monitoring systems. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEM BLY OF MARYLAND, 17
That the Laws of Maryland read as follows: 18

Article – Transportation 19

21–809. 20

(c) (1) Unless the driver of the motor vehicle received a citation from a police 21
officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 22
section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 23
recorded by a speed monitoring system while being operated in violation of this subtitle. 24

(d) (1) Subject to the provisions of paragraphs (2) through (4) of this 1
subsection, an agency shall mail to an owner liable under subsection (c) of this section a 2
citation that shall include: 3

(i) The name and address of the registered owner of the vehicle; 4

(ii) The registration number of the motor v ehicle involved in the 5
violation; 6

(iii) The violation charged; 7

(iv) The location where the violation occurred; 8

(v) The date and time of the violation; 9

(vi) A copy of the recorded image; 10

(vii) The amount of the civil penalty imposed and the date by which 11
the civil penalty should be paid; 12

(viii) A signed statement by a duly authorized law enforcement officer 13
or a technician employed by or under contract with an agency that, based on inspection of 14
recorded images, the motor vehicle was being operated in violation of this subtitle; 15

(ix) A statement that recorded images are evidence of a violation of 16
this subtitle; 17

(x) Information advising the person alleged to be liable under this 18
section of the manner and time in which liability as alleged in the citation may be contested 19
in the District Court; and 20

(xi) Information advising the person alleged to be liable under this 21
section that failure to pay the civil penalty or to contest liability in a timely manner: 22

2.] May result in the refusal by the Administration to register 24
the motor vehicle; and 25

[3.] 2. May result in the suspension of the motor vehicle 26
registration. 27

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effec t 28
October 1, 2026. 29
