AN ACT concerning 1

Montgomery County Board of Education – Elected Members – Compensation 2

MC 2–26 3

FOR the purpose of altering the compensation of an elected member and the president of 4
the Montgomery County Board of Education to be based on the compensation of 5
certain members of the General Assembly in effect at the beginning of the elected 6
member’s term; and generally relating to the compensation of elected members of 7
the Montgomery County Board of Education. 8

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19
That the Laws of Maryland read as follows: 20

Article – Education 21

(a) (1) In this subtitle the following words have the meanings indicated. 23

(3) “Elected member” means 1 of the 7 elected and voting members of the 1
Montgomery County Board or a member appointed to fill a vacancy of 1 of these 7 members. 2

(b) The Montgomery County Board consists of: 3

(1) 5 elected members, each of whom resides in a different board of 4
education district; 5

(2) 2 elected members who may reside anywhere in the county; and 6

(3) 1 student member. 7

(b) (1) An elected member of the county board is entitled to receive[: 9

(i) $25,000 annually as compensation; or 10

(ii) An annual salary set through legislation based on the 11
recommendations of the Montgomery County Board of Education Compensation 12
Commission in accordance with Title 28, Subtitle 1A of the Local Government Article ] 13
ANNUALLY AS CO MPENSATION THE SAME COMPENSATIO N AS A MEMBER OF THE 14
GENERAL ASSEMBLY, OTHER THAN THE PRESIDENT OF THE SENATE AND THE 15
SPEAKER OF THE HOUSE, IN EFFECT AT THE BEGINNING OF THE ELECTED 16
MEMBER’S TERM. 17

(2) The president of the county board is entitled to receive[: 18

(i) $29,000 annually as compensation; or 19

(ii) An annual salary set through legislation based on the 20
recommendations of the Montgomery County Board of Education Compensation 21
Commission in accordance with Title 28, Subtitle 1A of the Local Government Article ] 22
ANNUALLY AS COMPENSA TION $10,000 MORE THAN THE COMPEN SATION OF A 23
MEMBER OF THE GENERAL ASSEMBLY, OTHER THAN THE PRESIDENT OF THE 24
SENATE AND THE SPEAKER OF THE HOUSE, IN EFFECT AT THE BEGINNING OF THE 25
PRESIDENT’S TERM. 26

(3) An elected member is entitled to health insurance and to other fringe 27
benefits regularly provided to employees of the board of education under the same terms 28
and conditions extended to other employees of the board of education. 29

(4) A salary increase for an elected member under this subsection shall 30
take effect at the beginning of the term of office and may not increase during the term of 31
office. 32

SECTION 2. AND BE IT FURTHER ENACTED, That, in accordance with Article 1
III, § 35 of the Maryland Constitution, this Act may not be construed to extend or apply to 2
the salary or compensation of the president and members of the Montgomery County Board 3
of Education while serving in a term of office beginning before the effective date of this Act, 4
but the provisions of this Ac t concerning the salary or compensation of the president and 5
members of the Montgomery County Board of Education shall take effect at the beginning 6
of the next following term of office. This limitation does not apply to an individual appointed 7
or elected after the effective date of this Act to fill out an unexpired term. 8

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 9
October 1, 2026. 10
