FOR the purpose of altering the definition of recycling to exclude certain chemical 3

SECTION 1. BE IT ENACTED BY THE GENERAL A SSEMBLY OF MARYLAND, 22
That the Laws of Maryland read as follows: 23

9–1701. 1

(a) In this subtitle the following words have the meanings indicated. 2

(q) (1) “Recycling” means any process in which recyclable materials are 3
collected, separated, or processed and returned to the marketplace in the form of raw 4
materials or products. 5

(2) (I) “RECYCLING” DOES NOT INCLUDE ANY OF THE FOLLOWING 6
CHEMICAL CONVERSION PROCESSES: 7

1. PYROLYSIS; 8

2. HYDROPYROLYSIS; 9

3. METHANOLYSIS; 10

4. GASIFICATION; OR 11

5. ENZYMATIC BREAKDOWN. 12

(II) “RECYCLING” DOES NOT INCLUDE ANY SIMILAR CHEMICAL 13
CONVERSION PROCESSES, AS DETERMINED BY THE DEPARTMENT. 14

(A) A PERSON MAY NOT BUILD IN THE STATE A FACILITY THAT CONVERTS 16
PLASTIC TO FUEL OR FEEDSTOCK THROUGH: 17

(1) PYROLYSIS; 18

(2) HYDROPYROLYSIS; 19

(3) METHANOLYSIS; 20

(4) GASIFICATION; 21

(5) ENZYMATIC BREAKDOWN; OR 22

(6) A SIMILAR CHEMICAL CONVERSION PROCESS, AS DETERMINED BY 23
THE DEPARTMENT. 24

(B) THE DEPARTMENT MAY ADOPT REGULATIONS TO IMPLE MENT THIS 25

October 1, 2026. 3
