AN ACT concerning 1

State Procurement – Submission of Subcontractor Agreements 2

FOR the purpose of requiring a recommended awardee of a State procurement contract to 3
submit a certain copy of a subcontractor agreement or contract to the proc urement 4
officer before the unit awards the procurement contract; and generally relating to 5
subcontractor agreements and State procurement contracts. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

Article – State Finance and Procurement 14

13–230. 15

(A) THIS SECTION APPLIES TO ANY PROCUREMENT C ONTRACT IN WHICH 16
THE RECOMMENDED AWAR DEE EXECUTES AN AGRE EMENT OR CONTRACT WI TH A 17
SUBCONTRACTOR, REGARDLESS OF WHETHE R THE PROCUREMENT CONTRACT 18
REQUIRES THE PRIMARY CONTRACTOR TO EMPLOY A SUBCONTRACTOR. 19

(B) BEFORE A UNIT AWARDS A PROCUREMENT CONTRA CT, THE 20
RECOMMENDED AWARDEE SHALL SUBMIT TO THE PROCUREMENT OFFICER A COPY 21
OF ANY AGREEMENT OR CONTRACT THE RECOMMENDED AWARDEE HAS EXECUTED 22
WITH A SUBCONTRACTOR. 23

(C) A RECOMMENDED AWARDEE MAY REDACT A N AGREEMENT OR A 1
CONTRACT SUBMITTED U NDER SUBSECTION (B) OF THIS S ECTION TO REMOVE 2
CONFIDENTIAL INFORMATION, PROPRIETARY COMMERCI AL INFORMATION , OR 3
TRADE SECRETS CONTAINED IN THE AGREEMENT. 4

(D) THE BOARD SHALL ADOPT REGULATIONS TO CARRY OUT THIS SECTION. 5

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 6
October 1, 2026. 7
