AN ACT concerning 1
Criminal Procedure – Expungement – Conviction of Distribution of Controlled 2
Dangerous Substance 3
FOR the purpose of altering a certain list of felony convictions that are eligible for 4
expungement to include distributing or dispensing a controlled dangerous substance; 5
and generally relating to expungement. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17
That the Laws of Maryland read as follows: 18

5–602. 20
(a) Except as otherwise provided in this title, a person may not: 21
(1) distribute or dispense a controlled dangerous substance; or 22

(2) possess a controlled dangerous substance other than cannabis in 1
sufficient quantity reasonably to indicate under all circumstances an intent to distribute or 2
dispense a controlled dangerous substance. 3

(a) A person may file a petition listing relevant facts for expungement of a police 6
record, court record, or other record maintained by the State or a political subdivision of 7
the State if the person is convicted of: 8
(2) a felony that is a violation of: 9
(i) § 7–104 of the Criminal Law Article; 10
(ii) [the prohibition again st possession with intent to distribute a 11
controlled dangerous substance under § 5–602] § 5–602(A) of the Criminal Law Article; or 12
(iii) § 6–202(a), § 6–203, or § 6–204 of the Criminal Law Article; or 13
SECTION 2. AND BE IT FURTHER ENACTED, That this A ct shall take effect 14
October 1, 2026. 15
