AN ACT concerning 1

Public Safety – State Law Enforcement Agencies – Hiring Restriction 2
(ICE Breaker Act) 3

FOR the purpose of prohibiting certain State law enforcement agencies from hiring certain 4
individuals who were hired by a certain federal agency after a certain date ; and 5
generally relating to hiring by State law enforcement agencies. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

Article – Public Safety 14

3–535. 15

(A) (1) IN THIS SECTION, “STATE LAW ENFORCEMENT AGENCY” MEANS A 16
GOVERNMENTAL POLICE FORCE, SECURITY FORCE , OR LAW ENFORCEMENT 17
ORGANIZATION OF THE STATE THAT BY STATUTE, ORDINANCE, OR COMMON LAW IS 18
AUTHORIZED TO ENFORCE THE GENERAL CRIMINAL LAWS OF THE STATE. 19

(2) “STATE LAW ENFORCEMENT AGENCY” INCLUDES: 20

(I) THE DEPARTMENT OF STATE POLICE; 1

(II) THE MARYLAND TRANSPORTATION AUTHORITY POLICE; 2

(III) THE POLICE FORCES OF THE DEPARTMENT OF NATURAL 3
RESOURCES; 4

(IV) THE POLICE FORCE OF THE MARYLAND CAPITOL POLICE 5
OF THE DEPARTMENT OF GENERAL SERVICES; 6

(V) THE OFFICE OF STATE FIRE MARSHAL; 7

(VI) THE POLICE FORCE OF THE MARYLAND DEPARTMENT OF 8
HEALTH; 9

(VII) THE FIELD ENFORCEMENT DIVISION OF THE 10
COMPTROLLER’S OFFICE; AND 11

(VIII) THE FIELD ENFORCEMENT DIVISION OF THE ALCOHOL, 12
TOBACCO, AND CANNABIS COMMISSION. 13

(B) A STATE LAW ENFORCEMENT AGENCY MAY NOT HIRE FOR EMPLOYMENT 14
AN INDIVIDUAL WHO WAS HIRED AS A SWORN OFFICER O F UNITED STATES 15
IMMIGRATION AND CUSTOMS ENFORCEMENT ON OR AFTER JANUARY 20, 2025. 16

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 17
apply only prospectively and may not be applied or interpreted to have any effect on or 18
application to any individual hired by a State law enforcement agency before the effective 19
date of this Act. 20

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 21
October 1, 2026. 22
