AN ACT concerning 1

Law Enforcement Officers’ Pension System – Seat Pleasant Police Department 2

FOR the purpose of requiring membership in the Law Enforcement Officers’ Pension 3
System for certain local law enforcement officers of the Seat Pleasant Police 4
Department under certain circumstances; providing that a certain individual is 5
entitled to eligibility service and creditable service that was earned before the 6
effective date of the Seat Pleasant Police Department’s participation in the Law 7
Enforcement Officers’ Pension System; and generally relating to the Seat Pleasant 8
Police Department’s participation in the Law Enforcement Officers’ Pension System. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

(A) THIS SECTION APPLIES TO AN INDIVIDUAL WHO IS A LOCAL LAW 19
ENFORCEMENT OFFICER OF THE SEAT PLEASANT POLICE DEPARTMENT: 20
2 HOUSE BILL 872

(1) IN A PERMANENT FULL –TIME POSITION BEFORE THE EFFECTIVE 1
DATE AND WHO REMAINS A LOCAL LAW ENFORCEM ENT OFFICER OF THE SEAT 2
PLEASANT POLICE DEPARTMENT IN A PERMANENT FULL–TIME POSITION THROUGH 3
THE EFFECTIVE DATE; OR 4

(2) IN A PERMANENT FULL –TIME POSITION AFT ER THE EFFECTIVE 5
DATE. 6

(B) NOTWITHSTANDING ANY O THER PROVISION OF LA W, IF THE SEAT 7
PLEASANT POLICE DEPARTMENT BECOMES A PARTICIPATING GOVERN MENTAL 8
UNIT IN THE LAW ENFORCEMENT OFFICERS’ PENSION SYSTEM, MEMBERSHIP IN 9
THE LAW ENFORCEMENT OFFICERS’ PENSION SYSTEM IS MANDATORY F OR AN 10
INDIVIDUAL DESCRIBED UNDER SUBSECTION (A) OF THIS SECTION. 11

(C) IF THE SEAT PLEASANT POLICE DEPARTMENT COMMENCES 12
PARTICIPATION IN THE LAW ENFORCEMENT OFFICERS’ PENSION SYSTEM IN 13
ACCORDANCE WITH SUBSECTION (B) OF THIS SECTION, AN INDIVIDUAL DESCRIBED 14
UNDER SUBSECTION (A)(1) OF THIS SECTION IS ENTITLED TO ELIGIBILITY SERVICE 15
AND CREDITABLE SERVI CE IN THE LAW ENFORCEMENT OFFICERS’ PENSION 16
SYSTEM FOR EMPLOYMENT WITH THE SEAT PLEASANT POLICE DEPARTMENT 17
BEFORE THE EFFECTIVE DATE. 18

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 19
1, 2026. 20
