Public Health – Public Buildings – Hygiene Products 2

FOR the purpose of requiring public restrooms in public buildings to provide an adequate 3
supply of certain hygiene products; and generally relating to hygiene products in 4
public buildings. 5

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

SUBTITLE 10. HYGIENE PRODUCTS. 15

2–1001. 16

2 HOUSE BILL 941

(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS 1
INDICATED. 2

(B) “MENSTRUAL HYGIENE PRO DUCTS” MEANS APPROPRIATELY SIZED 3
TAMPONS, SANITARY NAPKINS, AND SANITARY PADS FOR USE IN CONNECTION WITH 4
THE MENSTRUAL CYCLE. 5

(C) (1) “PUBLIC BUILDING ” MEANS A BUILDING , A STRUCTURE , OR AN 6
IMPROVED AREA THA T IS OWNED , LEASED, OR OPERATED BY THE STATE OR A 7
POLITICAL SUBDIVISION OF THE STATE. 8

(2) “PUBLIC BUILDING” INCLUDES: 9

(I) A PUBLIC MASS TRANSPORTATION ACCOMMODATION, SUCH 10
AS A TERMINAL OR STATION, THAT IS SUPPORTED BY PUBLIC FUNDS; AND 11

(II) AN I MPROVEMENT OF A PUBL IC AREA USED FOR 12
GATHERING OR AMUSEMENT, INCLUDING A PUBLIC PARK OR RECREATION CENTER. 13

(3) “PUBLIC BUILDING ” DOES NOT INCLUDE A F ACILITY THAT IS 14
PRIMARILY USED TO PROVIDE PRIMARY OR SECONDARY EDUCATION. 15

(D) (1) “PUBLIC RESTROOM ” MEANS A SANITARY FAC ILITY AVAILABLE 16
TO THE GENERAL PUBLIC THAT CONTAINS AT LEAST ONE TOILET OR URINAL. 17

(2) “PUBLIC RESTROOM” DOES NOT INCLUDE A S ANITARY FACILITY 18
AVAILABLE TO THE GENERAL PUBLIC THAT CONTAINS ONLY A COMPOSTING TOILET 19
OR A PIT TOILET. 20

2–1002. 21

EACH PUBLIC RESTROOM IN EACH PUBLIC BUILD ING SHALL PROVIDE AN 22
ADEQUATE SUPPLY OF: 23

(1) HAND SOAP; 24

(2) TOILET PAPER; 25

(3) TOWELS OR OTHER HAND DRYING DEVICES; 26

(4) WATER; 27

(5) WASTE CONTAINERS; AND 28

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 2
October 1, 2026. 3
