AN ACT concerning 1

Office of the Attorney General – Independent Investigations Division – Federal 2
Law Enforcement or Immigration Enforcement 3

FOR the purpose of requiring the Independent Investigations Division of the Office of the 4
Attorney General to investigate the death of a person that occurs in connection with 5
an interaction with federal law enforcement or federal immigration enforcement ; 6
requiring the Division to submit a certain report at a certain time; requiring the 7
Attorney General to prosecute a certain case under certain circumstances ; and 8
generally relating to the Independent Investigations Division. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

(A) IN THIS SECTION , “SERIOUS PHYSICAL INJ URY” HAS THE MEANING 19
STATED IN § 3–201 OF THE CRIMINAL LAW ARTICLE. 20

(B) IF A PERSON DIES OR S USTAINS SERIOUS PHYS ICAL INJURY IN 21
CONNECTION WITH AN INTERACTION WITH FEDERAL LAW ENFORCEM ENT OR 22
FEDERAL IMMIGRATION ENFORCEMENT, THE DIVISION SHALL INVEST IGATE THE 23
DEATH OR SERIOUS PHYSICAL INJURY. 24

(C) AFTER CONDUCTING AN I NVESTIGATION UNDER SUBSEC TION (B) OF 1
THIS SECTION, THE DIVISION SHALL SUBMIT A REPORT TO THE GOVERNOR AND, IN 2
ACCORDANCE WITH § 2–1257 OF THIS ARTICLE, THE GENERAL ASSEMBLY SETTING 3
FORTH THE FINDINGS OF THE INVESTIGATION. 4

(D) IF THE ATTORNEY GENERAL DETERMINES THAT AN I NVESTIGATION 5
CONDUCTED UNDER SUBS ECTION (B) OF THIS SECTION PROV IDES SUFFICIENT 6
GROUNDS FOR PROSECUT ION OF A FEDERAL LAW ENFORCEMENT OFFICER OR A 7
FEDERAL IMMIGRATION ENFORCEMENT OFFICER FOR THE COMMISSION O F A 8
CRIME, THE ATTORNEY GENERAL SHALL PROSECUTE THE CASE. 9

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency 10
measure, is necessary for the immediate preservation of the public health or safety, has 11
been passed by a yea and nay vote supported by three –fifths of all the members elected to 12
each of the two Houses of the General Assembly, and shall take effect from the date it is 13
enacted. 14
