State Department of Education – Organ Donation – Development of Educational 2
Materials 3
FOR the purpose of requiring the State Department of Education to consult with a certain 4
entity that operates the donor registry and procurement organizations in the 5
development, updating, or approving of certain educational materials relating to 6
organ, eye, and tissue donation; and generally relating to educational materials 7
relating to organ, eye, and tissue donation. 8
BY repealing and reenacting, without amendments, 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2
That the Laws of Maryland read as follows: 3
Article – Education 4
1–101. 5
(a) In this article, unless the context requires otherwise, the following words have 6
the meanings indicated. 7
(f) “Department” means the State Department of Education. 8
7–455. 9
(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS 10
INDICATED. 11
(2) “DONOR REGISTRY” HAS THE MEANING STATED IN § 4–501 OF THE 12
ESTATES AND TRUSTS ARTICLE. 13
(3) “PROCUREMENT ORGANIZATION” HAS THE MEANING STATED IN § 14
4–501 OF THE ESTATES AND TRUSTS ARTICLE. 15
(B) IF THE DEPARTMENT DEVELOPS, UPDATES, OR APPROVES 16
CURRICULUM GUIDANCE , INSTRUCTIONAL RESOUR CES, OR PROFESSIONAL 17
DEVELOPMENT MATERIALS REGARDING ORGAN, EYE, AND TISSUE DONATION FOR 18
USE BY COUNTY BOARDS, THE DEPARTMENT SHALL CONSULT WITH: 19
(1) THE QUALIFIED NONPROFIT ENTITY THAT OPERATES THE DONOR 20
REGISTRY UNDER § 4–516 OF THE ESTATES AND TRUSTS ARTICLE; AND 21
(2) PROCUREMENT ORGANIZATIONS SERVING IN THE STATE. 22
(C) THE DEPARTMENT MAY USE OR REFERENCE EXISTIN G EDUCATIONAL 23
MATERIALS THAT WERE PREVIOUSLY DEVELOPED BY OR BEING USED BY THE DONOR 24
REGISTRY OR A PROCUREMENT ORGANIZATION IF THE EDUCATIONAL MATERIALS 25
ARE: 26
(1) AGE APPROPRIATE; 27
(2) EVIDENCE–BASED AND MEDICALLY ACCURATE; AND 28

(3) CONSISTENT WITH THE MARYLAND REVISED UNIFORM 1
ANATOMICAL GIFT ACT UNDER TITLE 4, SUBTITLE 5 OF THE ESTATES AND TRUSTS 2
ARTICLE. 3
Article – Estates and Trusts 4
4–501. 5
(a) In this subtitle the following words have the meanings indicated. 6
(h) “Donor registry” means a database that contains records of anatomical gifts 7
and amendments to or revocations of anatomical gifts as provided in § 4–516 of this subtitle. 8
(r) “Organ procurement organization” means a person designated by the 9
Secretary of the United States Departme nt of Health and Human Services as an organ 10
procurement organization. 11
(v) “Procurement organization” means an eye bank, an organ procurement 12
organization, or a tissue bank. 13
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 14
1, 2026. 15
