Authorized Transactions 3

FOR the purpose of authorizing a circuit court to authorize or direct a transaction that 4
grants access to financial records or establishes eligibility for government assistance 5
programs for a minor or disabled person under a certain circumstance; and generally 6
relating to assuming jurisdiction over the property of a minor or disabled person. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14

Article – Estates and Trusts 15

13–204. 16

(a) (1) If a basis exists as described in § 13 –201 of this subtitle for assuming 17
jurisdiction over the property of a minor or disabled person, the circuit court, without 18
appointing a guardian, may authorize or direct a transaction with respect to the property, 19
service, or care arrangement of the minor or disabled person. 20

(2) The transactions described under paragraph (1) of this subsection 1
include: 2

(i) Payment, delivery, deposit, or retention of funds or property; 3

(ii) Sale, mortgage, lease, or other transfer of property; 4

(iii) Purchase of contracts for an annuity, life care, training, or 5
education; 6

(iv) Making the election to take an elective share of an estate subject 7
to election under § 3–403 of this article; [or] 8

(V) GRANTING ACCESS TO FINANCIAL RECORDS; 9

(VI) ESTABLISHING ELIGIBIL ITY FOR GOVERNMENT 10
ASSISTANCE PROGRAMS; OR 11

[(v)] (VII) Any other transaction described in: 12

1. § 13–203(c)(2) of this subtitle; 13

2. Title 9, Subtitle 2 of this article; or 14

3. § 15–102 of this article. 15

(b) Before approving a transaction or arrangement under this section, the court 16
shall consider the interests of creditors and dependents of the minor or disabled person and 17
whether the property of the minor or disabled person needs the continuing protection 18
provided by a guardian. 19

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 20
October 1, 2026. 21
